Recommendation Concerning the Scheduling of an Appeal Hearing of a Decision by the Contractor Competency Board on February 3, 2016, Petitioned by James Freeman - Donald R. Mayo, CBO, Building Services Department Director
That the Board approve the scheduling of an Appeal Hearing for April 7, 2016 at 5:32 p.m., to review the Petition for Review of the Contractor Competency Board Decision (made at its February 3, 2016, meeting), as filed by James Freeman, Respondent, in the Complaint No.: COM151100033 - Escambia County Contractor Competency Board vs. James Freeman d/b/a Freeman Roofing Company.
BACKGROUND:
The above referenced case is a contractor complaint filed on November 16, 2015, against James Freeman d/b/a Freeman Roof Company, Certificate of Competency License No.: RR0133. Mr. Freeman is contesting the February 3, 2016. decision of the Contractor Competency Board wherein it found Respondent, James Freeman d/b/a Freeman Roofing, in violation of the following: Count I: Section 18-37(d)(9)(h) of the Escambia County Code of Ordinances and F.S. § 489.119, as amended, “Failure to supervise …” ; and Count II: Section 18-37(d)(13)(c)(3) of the Escambia County Code of Ordinances and F.S. § 489.129(1)(n), as amended, "Misconduct or Incompetency in the practice of contracting as set forth in F.S.§ 489.129(1)(n), as amended."
Based upon the Contractor Competency Board findings, it was ordered that Respondent, James Freeman, as to Count I, be assessed a $250.00 fine and a Letter of Reprimand be placed in his permanent Contractor file; as to Count II, the Board assessed a $1000.00 fine and a Letter of Reprimand be placed in his permanent Contractor file. The Board also assessed administrative costs in the amount of $350, for a total of $1,600 in fines and costs.
Respondent, James Freeman, is seeking an appeal of the Contractor Competency Board's decision on February 3, 2016.
