RECOMMENDATION:
5:31 p.m. Public Hearing for consideration of adopting an Ordinance amending Volume 1, Chapter 82, Article III, Section 82-101, of the Escambia County Code of Ordinances, relating to Permits and Certificate of Need.
Recommendation: That the Board adopt an Ordinance amending Volume I, Chapter 82, Article III, Section 82-101, of the Escambia County Code of Ordinances, relating to Permits and Certificate of Need.
BACKGROUND:
At its May 5, 2016 meeting the Board approved setting the Public Hearing for consideration of amending the Permits and Certificate of Need.
Section 82-101 of the Code of Ordinances currently states that any person who engages in any solid waste management activity must possess a Certificate of Need or current County franchise. The Certificate of Need is defined as written approval by the Board for the director to issue a permit. Where a solid waste permit is issued by the Board of County Commissioners, the requirement for a Certificate of Need appears to be duplicative.
