RECOMMENDATION:
5:45 p.m. - A Public Hearing Concerning the Review of an Ordinance Amending LDC Chapter 4 Regarding Recreational Vehicles

That the Board of County Commissioners (BCC) take the following action:

A. Review and adopt Option A Ordinance as recommended by the Planning Board to (1) make RV use as living quarters available throughout the county in zoning districts that allow manufactured homes and (2) allow other RV use outside of MH parks, campgrounds, and RV parks for up to 30 days in a calendar year rather than the current 14;

OR

B. Review and adopt Option B Ordinance that was the draft that went to the Planning Board that allowed RV use in commissioner District 5 where the zoning allowed manufactured homes, and otherwise limited RV use outside of MH parks, campgrounds, and RV parks to 14 days in a calendar year (what is currently allowed).
BACKGROUND:
Although recreational vehicles are not dwelling units, they can provide useful temporary living quarters beyond their primary recreational, camping, and travel uses.  However, any such use of recreational vehicles outside of duly licensed campgrounds, recreational vehicle parks, or mobile home parks requires land use standards to protect the public health, safety, and general welfare.

On August 4, 2020, the Planning Board had a public hearing on a draft ordinance to allow recreational vehicles (RV) as living quarters in any zoning districts where mobile homes are allowed as a permitted use and only in District 5 with certain conditions met.  During the public hearing, the Planning Board raised some concerns on certain provisions of the draft ordinance as written.  First, there is the issue of the proposed language indicating that RVs be used as living quarters where mobile homes are permitted in District 5 only. The other concern was the issue of the existing language of the 14 day requirement for RVs. The Planning Board recommended that changes be made to address the two issues.
BUDGETARY IMPACT:
No budgetary impact is anticipated by the adoption of this Ordinance.
LEGAL CONSIDERATIONS/SIGN-OFF:
The attached Ordinance has been reviewed and approved for legal sufficiency by Kia M. Johnson, Assistant County Attorney.  Any recommendations or legal sufficiency comments made in that review are also attached herein.
PERSONNEL:
No additional personnel are required for implementation of this Ordinance.
POLICY/REQUIREMENT FOR BOARD ACTION:
Amendment of the LDC requires public hearing review and recommendation by the Board prior to action by the BCC.  The proposed Ordinance is consistent with the Board’s goal “to increase citizen involvement in, access to, and approval of, County government activities.”
IMPLEMENTATION/COORDINATION:
This Ordinance, amending the LDC, will be filed with the Department of State following adoption by the board.

Implementation of this Ordinance will consist of an amendment to the LDC and distribution of a copy of the adopted Ordinance to staff and interested citizens.

The proposed Ordinance was prepared by the Development Services Department, in cooperation with  the County Attorney’s Office and all interested citizens. The Development Services Department will ensure proper advertisement.
