RECOMMENDATION:
Recommendation Concerning the Scheduling of a Public Hearing to Establish a "Slow Speed - Minimum Wake" Zone in a Certain Eastern Portion of Bayou Garcon and its Eastern Tributary Creek - J. Taylor "Chips" Kirschenfeld, Director, Department of Natural Resources Management

That the Board approve and authorize the scheduling of a Public Hearing on July 16, 2020, at 9:02 a.m., to consider adoption of an Ordinance to Establish a "Slow Speed - Minimum Wake" Zone in a Certain Eastern Portion of Bayou Garcon and its Eastern Tributary Creek.
BACKGROUND:
Section 327.46(1)(b)2.c., Florida Statutes, authorizes Counties to enact an Ordinance establishing a Slow Speed - Minimum Wake area on a creek, stream, canal, or similary linear waterway if the wateway is less than 75 feet in width from shoreline to shoreline.

The portion of Bayou Garcon and its tributary creek east of 30o19'24.84" N, 87o25'19.32" W, is less than 75 feet in width from shoreline to shorline. Because of the sinuous nature and narrow dimensions of the creek, and obstructed visibility due to tall shoreline vegetation, high speed vessel traffic in and around the waters east of 30o19'24.84" N, 87o25'19.32" W, constitutes a real and present danger.

No budgetary impact associated with this Recommendation.

PERSONNEL:
No impact to personnel associated with this Recommendation.
POLICY/REQUIREMENT FOR BOARD ACTION:
The Board must approved the scheduling of public hearings, per F.S. 166.41.
IMPLEMENTATION/COORDINATION:
Marine Resources Division, under the Department of Natural Resources Management, will coordinate with the Escambia County Sheriff's Office and the Florida Fish and Wildlife Conservation Commission.
