Recommendation Concerning an Interlocal Cost-Sharing Agreement with Emerald Coast Utilities Authority for Beach Haven Northeast Drainage and Sanitary Sewer Project, Phase 2 - J. Taylor "Chips" Kirschenfeld, Director, Natural Resources Management
 
That the Board approve and authorize the Chairman to sign the Interlocal Cost-Sharing Agreement between Escambia County and the Emerald Coast Utilities Authority (ECUA) for construction services for the Beach Haven Northeast Drainage and Sanitary Sewer Project, Phase 2.
BACKGROUND:
On September 7, 2017, the Board approved Agreement No. RES04 with the State of Florida Department of Environmental Protection (FDEP), Division of Water Restoration Assistance Deepwater Horizon Program, pursuant to a Grant from the Gulf Coast Ecosystem Restoration Council. The Agreement included $5,529,003 for the Beach Haven Northeast Phase 2 Project to construct stormwater and sewer infrastructure.

As with Phase 1, the County will contract the construction of the entire project. The construction estimate for Phase 2 is currently $10.3 million. The estimated cost of just the sanitary sewer related infrastructure is $3.6 million. Under the proposed Interlocal Cost-Sharing Agreement, 40% of the available FDEP Grant funds or $2,211,601.20 will be used to construct sanitary sewer infrastructure. Sanitary sewer infrastructure costs exceeding 40% of the available FDEP funds will be reimbursed by Emerald Coast Utilities Authority (ECUA), according to the proposed line-by-line breakdown of individual construction items included as Exhibit B to the Agreement. On December 17, 2019, ECUA’s Board obligated $1,757,418 to reimburse the County for construction of Phase 2. Funding obligated by ECUA is sufficient to cover the estimated cost of sewer infrastructure not constructed under the FDEP Grant. Available County funding sources are sufficient to cover the cost of the remaining anticipated non-sewer infrastructure construction costs for Phase 2. County funding sources for Phase 2 include Local Option Sales Tax (LOST) IV, Community Redevelopment Agency (CRA), FDEP Agreement No. RES04, and a separate Federal Clean Water Act Section 319(h) Grant.

Beach Haven Northeast Drainage and Sanitary Sewer Project, Phase 2 is a continuation of the Phase 1 work deemed completed on February 4, 2020. The total cost of Phase 1 was $10,818,724.79, of which the County contributed $7,284,160.66 and ECUA contributed $3,534,564.13 under Amendment No. 1 to a Cost-Sharing Agreement approved by the BCC on August 4, 2016, and amended on November 3, 2016. County construction costs for Phase 1 were offset by Grants from the National Fish & Wildlife Foundation and FDEP contributing $4,977,250 and $500,000, respectively. Engineering costs for Phase 1 and 2 were also divided between the County and ECUA, according to the terms of another Cost-Sharing Agreement approved by the BCC on July 12, 2012, and amended on November 15, 2012. The total cost of engineering design services to date has been $1,061,390.59, of which the County has contributed $661,618.59 and ECUA has contributed $399,772.
BUDGETARY IMPACT:
Table below summarizes estimated construction costs and available funding sources.  ECUA will reimburse the County for sanitary sewer construction costs incurred and invoiced, as outlined in the Agreement.

LEGAL CONSIDERATIONS/SIGN-OFF:
The Agreement was reviewed and approved as to legal form and sufficiency by Stephen G. West, Senior Assistant County Attorney.
PERSONNEL:
Escambia County staff from Natural Resources Management, Engineering, and other departments will work with ECUA during the duration of the project, as outlined in the Agreement.
POLICY/REQUIREMENT FOR BOARD ACTION:
Board Policy II.B.8 and §163.01, Florida Statutes, grants the Board authorization to enter into lnterlocal Agreements.
IMPLEMENTATION/COORDINATION:
Upon approval by the BCC, two original Agreements executed by the Chairman or Vice Chairman will be provided by the NRM Department to ECUA for acceptance by their Board. Upon approval by the ECUA Board, NRM will ensure one fully executed original is provided to the Clerk’s Office for the record.
