RECOMMENDATION:
Recommendation Concerning a State of Florida, Division of Emergency Management Federally-Funded Subaward and Grant Agreement - Jason Rogers, Public Safety Department Director

That the Board take the following action regarding the Federally-Funded Subaward and Grant Agreement Number G0137:

A. Approve the State of Florida, Division of Emergency Management (FDEM), Federally-Funded Subaward and Grant Agreement, providing funds in the amount of $19,949.43, to assist local emergency management agencies with preventing, preparing for, and responding to the COVID-19 public health emergency for the period of April 27, 2020, through June 30, 2021;

B. Authorize the Chairman or Vice Chairman to execute the Subaward and Grant Agreement; and

C. Authorize Eric Gilmore, Emergency Management Manager, to execute and certify each Grant quarterly report, reimbursement request, Grant close-out report, and any subsequent documents as appropriate to implement this Grant with the following authority:

"By signing this report, I certify to the best of my knowledge and belief that the report is true, complete, and accurate, and the expenditures, disbursements, and cash receipts are for the purposes and objectives set forth in the terms and conditions of the Federal Award. I am aware that any false, fictitious, or fraudulent information, or the omission of any material fact, may subject me to criminal, civil, or administrative penalties for fraud, false statements, false claims or otherwise.  (U.S. Code Title 18, Section 1001 and Title 31, Sections 3729-3730 and 3801-3812)."

The County Attorney's Office has requested that the Board be made aware of the following language within the Agreement:

Section (18) Mandated Conditions and Other Laws, Subsection (b), that "This Agreement shall be construed under the laws of the State of Florida, and venue for any actions arising out of this Agreement shall be in the Circuit Court of Leon County."

BACKGROUND:
EMPG-S awards are based on the CARES Act and section 662 of the Post-Katrina Emergency Management Reform Act of 2006, as amended (6 U.S.C. § 762). 

The Fiscal Year (FY) 2020 Emergency Management Performance Grant Program – COVID-19 Supplemental (EMPG-S) assists tribes and local governments with their public health and emergency management activities supporting the prevention of, preparation for, and response to the ongoing Coronavirus Disease 2019 (COVID-19) public health emergency. EMPG-S funding is to support planning and operational readiness for COVID-19 preparedness and response, development of tools and strategies for prevention, preparedness, and response, and ongoing communication and coordination among federal, State, local, tribal, and territorial partners throughout the response. This Agreement is providing funds, in the amount of $19,949.43, with a Contract period from April 27, 2020, through June 30, 2021.
BUDGETARY IMPACT:
The Grant funds are desinged as a cost reimbursement funding source to support planning and operational readiness for COVID-19 preparedness and response, development of tools and strageies for prevention, preparedness, and response, and ongoing communication and coordination among federal, State, local, tribal, and territorial partners through the response. These funds require a non-federal 50% match that will utilize existing General Fund appropriation from the Escambia County Division of Emergency Management budget or other eligible non-federal funding option. No additional funds are required to meet the match requirements or to implement this Grant. 
LEGAL CONSIDERATIONS/SIGN-OFF:
Kristin Hual, Senior Asasistant County Attorney, has reviewed the Agreement and approved it as to form and legal sufficiency.

POLICY/REQUIREMENT FOR BOARD ACTION:
Board of County Commissioner's Policies require Board approval for all Grant Agreements.
IMPLEMENTATION/COORDINATION:
Eric Gilmore, Emergency Management Manager, will oversee implementation upon approval of the Agreement.  This Grant is being coordinated with FDEM.
