RECOMMENDATION:
Recommendation Concerning the Lease Agreement between Escambia County and Be Ready Alliance Coordinating for Emergencies (BRACE), for a Portion of County-Owned Property at 150 W. Maxwell Street, Pensacola, Florida - Cassie C. Boatwright, Facilities Management Director

That the Board take the following action:

A. Adopt and authorize the Chairman to sign a Resolution authorizing the lease of a portion of real property to BRACE, LLC; and

B. Approve and authorize the Chairman to sign a Lease Agreement between Escambia County and BRACE, LLC, for a portion of the property located at 150 W. Maxwell Street, Pensacola, Florida, 32501.

Rent is to be paid to the County, in the amount of $1 per year.

BACKGROUND:
Lease Agreement with BRACE, for a portion of real property located at 150 W. Maxwell Street (Exhibit A), Pensacola, FL 32501. The initial term of the lease is for three years and allows for the lease to be renewed for two successive terms of three years each.  

BRACE is a non-profit entity with the vision of making our community the most disaster resilient in America.
BUDGETARY IMPACT:
Rent is to be paid to the County in the amount of $1 per year.

The County will invoice Lessee for its proportional share of the utility service charges.  Lessee's initial proportional share of the monthly utility service charges is $843.83; Lessee shall reimburse the County for its share of the utility service charges within 30 days of the date of the invoice.  Lessee shall be responsible for paying the provider directly for any utility services not provided through the County's utility accounts, including but not limited to telephone, internet, and cable television.  Utility service charges will be reviewed in April of each year to ensure the charges align with the Lessee’s proportional share of expenses.  Should the utility charges increase by more than 3%, the following year’s annual cost will be submitted to the Lessee on May 1st of each year.  The Lessee may then determine if it will continue with the Lease or terminate the Lease as provided in Section 12.

The Lease Agreement is subject to Legal review and sign-off.
