RECOMMENDATION:
Recommendation Concerning the Conveyance of a Parcel of Real Property to the Florida Department of Transportation - Joy Jones, P.E., Engineering Department Director

That the Board take the following action concerning the conveyance of parcels of real property and easements to the Florida Department of Transportation (FDOT) for their improvement project on State Road (SR) 10 (US 90A/Nine Mile Road):

A. Adopt the Resolutions authorizing the conveyance of a parcel of real property and temporary easement to FDOT for their planned improvement project on SR 10 (US 90A/Nine Mile Road);
  • Resolution 1100 - deed(s) conveying private property acquired by FDOT on behalf of Escambia County
  • Resolution 702.1 - County rights-of-way to be used temporarily by FDOT
  • Resolution 100.3R - deed conveying County interest to FDOT

B. Approve the Quit Claim Deed (100.3R) and the Temporary Easement (702.1) to FDOT, for their planned improvement project on SR 10 (US 90A/Nine Mile Road); and

C. Authorize the Chairman to execute the Deed, the Temporary Easement, and the Resolutions related to these conveyances without further action of the Board.

The areas of interest are located in Commission District 1.
BACKGROUND:

The Temporary Easement includes all of the existing rights-of-way of Escambia County where there is an intersection with SR 10 (US 90A/Nine Mile Road), lying between the west line of Section 12, Township 1 South, Range 32 West (intersection of Mobile Highway and Silcox Lane) to the east line of Sections 6 and 7, Township 1 South, Range 31 West (intersection of W. Nine Mile Road and Beulah Road). The Quit Claim Deed is for any interest the County may have in a parcel that is currently owned by the Oswald Living Trust (John Howard McNaughton, Trustee). 

This property is located in the 9600 Block of Nine Mile Road (Parcel ID: 12-1S-32-2000-005-002). Escambia County obtained a 40-foot wide Drainage Easement over this property in 2001. The Quit Claim Deed will convey any interest from the County for that Easement to FDOT. FDOT's plans for this project will accommodate the drainage in this area. Per their current design, the existing ditch will remain and FDOT will add a stormwater pond next to it.

All costs associated with the relocation of any County facilities within the project area and for the recording of any documents will be borne by FDOT.

Staff reviewed this request and determined that the conveyance of the deed will have no adverse impact on the County and therefore have no objections to the requested conveyance.

The intent of the FDOT project is to improve the operation and safety of the intersection at SR 292 (Sorrento/Perdido Key Drive), at CR 292A (Gulf Beach Highway) and Innerarity Road in Escambia County. The main proposed improvements are the addition of a southbound left-turn lane, the addition of an eastbound right-turn lane, and the extension of the westbound left-turn lane. There are commercial parcels at three of the intersection quadrants. In order to accommodate the proposed improvements, the anticipated widening, milling and resurfacing, drainage improvements, signage, and pavement markings, traffic signalization, and roadway lighting will require additional right of way.

FDOT is ensuring that the County does not have any utility interests in the northwest corner of the intersection. In 1995, the Board of County Commissioners, upon the Board's Own Motion, vacated a portion of Corinna Street (f/k/a Alabama Road). In the Resolution for this action, the legal description states that the vacation of the property is subject to a utility easement being retained over said right of way, but does not specifically state the owner of the utility easement, so it could be viewed to be owned by Escambia County.

All costs associated with the relocation of any county facilities within the shown Parcels of 102 and 103, and for the recording of any documents, will be borne by FDOT.
