RECOMMENDATION: |
Recommendation Concerning the Locally Funded Agreement between the State of Florida Department of Transportation and Escambia County, Florida, for Right-of-Way Acquisition on State Road 173 (Blue Angel Parkway) - Joy Jones, P.E., Engineering Department Director
That the Board take the following action concerning the Locally Funded Agreement (LFA) between the State of Florida Department of Transportation (FDOT) and Escambia County, Florida, for right-of-way acquisition on State Road (SR) 173 (Blue Angel Parkway) from SR 292 (Sorrento Road) to north of SR 30 (US 98):
A. Adopt and authorize the Chairman to sign the Resolution authorizing the LFA;
B. Approve and authorize the Chairman to sign the LFA between the FDOT and Escambia County, Florida, obligating $5,000,000 for right-of-way acquisition on SR 173 (Blue Angel Parkway); and
C. Authorize the Chairman to execute, subject to Legal review and sign-off, any subsequent Agreements and program-related documents for this project that do not alter the finite terms of funding amounts or budgets.

BACKGROUND: |
FDOT and Escambia County have completed the planning phase (2007) and the engineering design phase (2019) to widen SR 173 (Blue Angel Parkway) from SR 292 (Sorrento Road) to SR 30 (US 98) to a 5-lane state arterial roadway.
Previously the Board took action to:
- 10/16/06 - Approved a Lump Sum Contract, in the amount of $950,000, to HDR Engineering, Inc. per PD 05-06.077, Project Development & Environmental (PD&E) Studies for State Road 173 (Blue Angel Parkway), from State Road 292 (Sorrento Road) to US Highway 98.
- 02/01/07 - Approved the Transportation Regional Incentive Program Agreement (TRIP) for the design of roadway improvements on Blue Angel Parkway from Sorrento Road (SR 292) to US 98; adopted a Resolution authorizing the Chairman to sign; and Authorized the Chairman to sign the Agreement and the Resolution.
- 04/18/13 - Approved the Amendment to TRIP, the Transportation Assignment Agreement; the Locally Funded Agreement, the Memorandum of Agreement, and adopted the Resolution authorizing the Chairman to sign the Agreements.
- 04/23/15 - Rescinded the BCC action on 04/18/13 and approved the Amendment to the TRIP, the Transportation Assignment Agreement, the Locally Funded Agreement, adopted and authorized the Chairman to sign the Resolution supporting the transfer of the SR 173 (Blue Angel Parkway) Project No. 421012-1-38-01 from Escambia County to FDOT.
- 01/21/16 - Authorized utilizing Fund 152 "Southwest Sector", Cost Center 110269, Object Code 56301, in the amount of $213,614, to fund Escambia County's portion of the design for the widening of State Road 173 (Blue Angel Parkway), from State Road 292 (Sorrento Road) to State Road 30 (US 98).
- 04/07/16 - Approved & Authorized the Chairman to sign the First Amendment to the Locally Funded Agreement and adopted and authorized the Chairman to sign the authorizing Resolution.
The total acquisition (including drainage) is estimated to cost $10,100,000. The estimated construction cost for this project is $49,300,000. The remaining right-of-way funding has been prioritized within the Regional Transportation Planning Organization (TPO) Priority Listing (Strategic Intermodal System [SIS]) for funding in 2026. (Construction year funding has not been identified at this time).
With this current obligation of funding from Escambia County, FDOT will begin the right-of-way acquisition phase for SR 173 (Blue Angel Parkway) from SR 292 (Sorrento Road) to SR 30 (US 98) and will give higher priority to funding the remaining need for this project. FDOT will undertake and administer the project, and Escambia County will contribute a lump sum payment in the amount of $5,000,000 toward the acquisition cost. |
BUDGETARY IMPACT: |
Escambia County will obligate $5,000,000 as programmed in LOST IV.

LEGAL CONSIDERATIONS/SIGN-OFF: |
The Locally Funded Agreement and the Resolution have been reviewed and approved as to form and legal sufficiency by the Escambia County Attorney's Office. |
PERSONNEL: |
No new personnel will be required. |
POLICY/REQUIREMENT FOR BOARD ACTION: |
Board policy requires Board approval of all Agreements. |
IMPLEMENTATION/COORDINATION: |
Upon Board approval, Escambia County Engineering staff will transmit the signed LFA to FDOT for execution. Once the LFA is executed, funds will be forwarded to FDOT for the project. Staff will continue to coordinate with FDOT. |
