RECOMMENDATION:

Recommendation Concerning the State of Florida Department of Transportation Off-System Project Agreement Related to State Road 10 (US 90A) Nine Mile Road Including Tower Ridge Road - Joy Jones, P.E., Engineering Department Director

That the Board take the following action concerning the State of Florida Department of Transportation (FDOT) Off-System Project Agreement Related to State Road 10 (US 90A) Nine Mile Road including Tower Ridge Road:

A. Adopt the Resolution authorizing the Agreement;

B. Approve the State of Florida Department of Transportation Off-System Project Agreement between FDOT and Escambia County related to State Road 10 (US 90A) Nine Mile Road including Tower Ridge Road; and

C. Authorize the Chairman or Vice Chairman to execute the documents and any subsequent documents required for implementation of the project.

This project is located in Commission District 1.

BACKGROUND:

Federal funding is available for right-of-way acquisition, for State Road (SR) 10 (US 90A) Nine Mile Road from SR 10A (US 90) to CR 99 Beulah Road in Escambia County. Tower Ridge Road is a County-owned road that intersects SR 10 and will be realigned as a part of the overall project, specifically, removing the existing ninety-degree turn and extending the two-lane road south to connect to Nine Mile Road under 23 CFR 650.413(c) (see provided drawing).

The parties agree that it is in the best interest of the State of Florida (DEPARTMENT) and the LOCAL AGENCY (Escambia County), for the DEPARTMENT, if necessary, to act for Escambia County in the acquisition of the real property through voluntary acquisition and through the use of the power of eminent domain, if necessary to complete this project, as authorized by Section 336.467, Florida Statutes.

Approval of federal aid necessary to the project requires agreement from Escambia County to maintain the project or the portion of the project that is located on County right-of-way.

The Parties agree that it is in the best interest of each Party for the DEPARTMENT to undertake and complete all aspects of the roadway improvement work, including but not limited to the design, construction, construction inspection, utilities, permits, easements, and other associated tasks.

BUDGETARY IMPACT:

All right-of-way acquisition will be performed by FDOT.

LEGAL CONSIDERATIONS/SIGN-OFF:

Kristin Hual, Senior Assistant County Attorney, has reviewed and signed off on the Agreement and the Resolution.

PERSONNEL:

All right-of-way acquisition and construction work will be performed by FDOT. There is no impact to County personnel.

POLICY/REQUIREMENT FOR BOARD ACTION:

Board of County Commissioners' policies require Board approval for these actions.

IMPLEMENTATION/COORDINATION:

Upon Board approval and Chairman or Vice Chairman execution, the Agreement and Resolution will be returned to FDOT for final execution and recording.
