RECOMMENDATION:
Recommendation Concerning the Acceptance of Two Drainage Easements for the Klondike Road at Cedarbrook Estates Pond Project - Joy Jones, P.E., Engineering Department Director

That the Board take the following action concerning the acceptance of two Drainage Easements for the Klondike Road at Cedarbrook Estates Pond Project:

A. Accept the donation of two Drainage Easements needed for the Klondike Road at Cedarbrook Estates Pond Project;

B. Authorize the payment of documentary stamps because the property is being donated for governmental use, which is for drainage improvements, and the county benefits from the acceptance of this property, which enhances safety and well-being of the citizens of Escambia County;

C. Authorize the payment of incidental expenditures associated with the recording of documents; and

D. Authorize the Chairman or Vice Chairman to accept the Easements on the day of delivery of the Easements to the Chairman or Vice Chairman, and to authorize the Chairman or Vice Chairman to acknowledge the Board's acceptance at that time.

These parcels are located in Commission District 1.

BACKGROUND:
The property owners at 4400 Cedarbrook Drive and 7721 Klondike Road have reported flooding from an over-topping County-maintained pond within Cedarbrook Estates. The pond, located on the northeast property line of 7721 Klondike Road, was originally designed and constructed as a dry pond and has failed in this capacity due to poor percolation rates. The purpose of the project is to install an under-drain and associated outfall in order to facilitate an adequate flow of water out of the pond, restoring its function as a dry pond. These Drainage Easements are needed to complete the project.
BUDGETARY IMPACT:
Funds for incidental expenses associated with the recording of documents are available in an Engineering Escrow Account accessed by the Escambia County Clerk's Office.
LEGAL CONSIDERATIONS/SIGN-OFF:
The Drainage Easements have been approved as to form and legal sufficiency by Stephen West, Senior Assistant County Attorney.
PERSONNEL:
All work associated with this request is being done in-house and no additional staff is required.
POLICY/REQUIREMENT FOR BOARD ACTION:
Upon Board approval, County staff will proceed in compliance with Section 46-139 of the Escambia County Code of Ordinances.
IMPLEMENTATION/COORDINATION:
Upon Board approval, staff will have the Drainage Easements recorded in the public records of Escambia County, Florida.
