RECOMMENDATION:
Recommendation Concerning the Acceptance of a Portion of Real Property for Road Right-of-Way for the Pine Barren Church Road Dirt Road Paving Project - Joy Jones, P.E., Engineering Department Director

That the Board take the following action concerning the acceptance of the donation of a portion of real property for road right-of-way (approximately 0.16 acre more or less), located at 5270 Pine Barren Church Road, from Pine Barren Baptist Church, Inc., for the Pine Barren Church Road Dirt Road Paving Project:

A. Accept the Warranty Deed donating a portion of real property, located at 5270 Pine Barren Church Road, from Pine Barren Baptist Church, Inc.,  for the Pine Barren Church Road Dirt Road Paving Project;

B. Authorize the payment of documentary stamps considering the property is being donated for governmental use for dirt road paving and improvements, and the County benefits from the acceptance of this property, which enhances the safety and well-being of the citizens of Escambia County;
 
C. Authorize the payment of incidental expenditures associated with the recording of documents; and 
 
D. Authorize the Chairman or Vice Chairman to accept the Easement documents as of the day of delivery of the Easement to the Chairman or Vice Chairman, and authorize the Chairman or Vice Chairman to acknowledge the Board's acceptance at that time.

This property is located in Commission District 5.

BACKGROUND:
Located in Commission District 5, the portion of Pine Barren Church Road between State Road (SR) 97 and the paved segment running north from County Road (CR) 4 has approximately 5,300 linear feet of unsurfaced roadway. This portion of the roadway is programmed in the Dirt Road Paving (DRP) Program. Base preparation and minor drainage work will be constructed by in-house crews and the paving and striping work will be contracted. The donation of real property from Pine Barren Baptist Church, Inc., is needed to complete the project.
BUDGETARY IMPACT:
Funds for incidental expenses associated with the recordings of documents are available in an Engineering Escrow Account accessed by the Escambia County Clerk's Office.
LEGAL CONSIDERATIONS/SIGN-OFF:
The Warranty Deed has been approved as to form and sufficiency and signed by the County Attorney's Office.
PERSONNEL:
All work associated with this request is being done in-house and no additional staff is required.
POLICY/REQUIREMENT FOR BOARD ACTION:
Upon Board approval, County staff will proceed in compliance with Section 46-139 of the Escambia County Code of Ordinances.
IMPLEMENTATION/COORDINATION:
Upon Board approval, staff will have the Warranty Deed recorded in the public records of Escambia County, Florida.
