RECOMMENDATION:
5:37 p.m. Public Hearing Concerning the Repeal and Replacement of Chapter 14 of the Escambia County Code of Ordinances, entitled "Buildings and Building Regulations".

Recommendation:  That the Board take the following action:

A. Ratify the scheduling and advertising of this May 7, 2020, public hearing at 5:37 p.m., which was previously scheduled for 9:01 a.m., on April 14, 2020; and

B. Review and adopt an Ordinance repealing and replacing in its entirety Chapter 14 of the Escambia County Code of Ordinances, entitled "Buildings and Building Regulations" providing for severability, inclusion in the code, and an effective date which is in the best interest of the County and its citizens.
BACKGROUND:
This proposed repeal and replacement of the Escambia County Code of Ordinances Chapter 14 entitled "Buildings and Building Regulations" will bring current the previously adopted Chapter 14 which is in the best interest of the County and its citizens. The previously adopted Chapter 14 contains items that are now obsolete within the Florida Building Code. Code references in the current Chapter 14 are no longer in effect, including but not limited to, the local wind speed map designations, permitting exemptions, and annual permitting allowances. The Building Officials Association of Florida provides a model Administrative Code for the 6th Edition (2017) Florida Building Code that most jurisdictions within Florida adapt to meet their local requirements and adopt.  Building Services has taken this model Administrative Code and inserted our local requirements for review as a proposed repeal and replacement to the current Escambia County Code of Ordinances Chapter 14.

LEGAL CONSIDERATIONS/SIGN-OFF:
The attached Ordinance has been reviewed by Kia Johnson, Assistant County Attorney.  
PERSONNEL:
No additional personnel are required for the implementation of this Ordinance.
POLICY/REQUIREMENT FOR BOARD ACTION:
The proposed Ordinance is consistent with the Board's goal " to ensure the health, safety, and welfare of the citizens of Escambia County."
IMPLEMENTATION/COORDINATION:
This Ordinance, repealing and replacing Chapter 14, will be filed with the Department of State following adoption by the Board.

Implementation of this Ordinance will consist of the repeal and replacement of Chapter 14 and distribution of a copy of the adopted Ordinance to interested citizens and staff.

The proposed Ordinance was prepared by the Building Services Department, in cooperation with the County Attorney's Office and all interested citizens.  The Building Services Department will ensure proper advertisement.
