RECOMMENDATION:
Recommendation Concerning the Conveyance of a Portion of Real Property Located at 3085 Robertson Road - Joy Jones, P.E., Engineering Department Director

That the Board take the following action concerning the conveyance of a portion of real property, located at 3085 Robertson Road, to Jerry David Westmoreland and Jean Ann Westmoreland:

A. Authorize conveyance of a Quit Claim Deed to Jerry David Westmoreland and Jean Ann Westmoreland, to confirm the return of this portion of real property previously conveyed to Escambia County in 1995; and

B. Authorize the Chairman or Vice Chairman to execute the Quit Claim Deed, and have it recorded at the County's expense in the Clerk of the Court Public Records.

This property is located in Commission District 2.

BACKGROUND:
Jerry David Westmoreland and Jean Ann Westmoreland are currently in negotiations to sell their property located at 3085 Robertson Road. The purchaser had a survey ordered which showed that a portion of a mobile home on the Westmorelands' property is located in the right-of-way.

The Westmorelands granted two Quit Claim Deeds to Escambia County on November 15, 1995, which are recorded in Official Records Book 4206, Pages 917-918 and Pages 919-920. The Quit Claim Deed recorded in Official Records Book 4206, Pages 919-920, was deeded with the incorrect legal description. If the Board approves a Quit Claim on this property, the updated legal description will realign the right-of-way, and the mobile home will no longer be located on the right-of-way. 
BUDGETARY IMPACT:
Funds for incidental expenses associated with recording of documents are available in an Engineering Escrow Account accessed by the Escambia County Clerk's Office.
LEGAL CONSIDERATIONS/SIGN-OFF:
The Quit Claim Deed was approved as to form and legal sufficiency by Stephen G. West, Senior Assistant County Attorney.
PERSONNEL:
All work associated with this request is being done in-house and no additional staff is required.
POLICY/REQUIREMENT FOR BOARD ACTION:
Upon Board approval, Escambia County staff will proceed in compliance with Section 46-139 of the Escambia County Code of Ordinances.
IMPLEMENTATION/COORDINATION:
Upon Board approval, staff will have the Quit Claim Deed recorded in the public records of Escambia County, Florida.
