RECOMMENDATION:
5:33 p.m. Public Hearing to Consider the Vacation of a Portion of the First Addition of Wesleyan Terrace Subdivision Plat on the Board's Own Motion.

Recommendation: That the Board take the following action concerning the Vacation of a Portion of the First Addition of Wesleyan Terrace Subdivision Plat on the Board's Own Motion:
  
A. Approve or deny the Vacation of a Portion of the First Addition of Wesleyan Terrace Subdivision Plat on the Board's Own Motion;

B. Adopt the Resolution to Vacate; and

C. Authorize the Chairman or Vice Chairman to accept the documents as of the day of delivery of the documents to the Chairman or Vice Chairman, and authorize the Chairman or Vice Chairman to execute them at that time.

The real property mentioned in this Petition to Vacate is located in Commission District 2.
BACKGROUND:
In 2015, the National Fish and Wildlife (NFWF) awarded Escambia County over $11 million in RESTORE funding for the construction of five projects within the Bayou Chico watershed to improve water quality and enhance wildlife habitat. Projects are located in all three of the main freshwater tributaries to Bayou Chico, including a floodplain restoration/expansion project along Jackson Creek. 

Meeting in regular session on July 23, 2015, the Board authorized staff to begin the process of obtaining necessary easements, parcels, and permits to complete the NFWF-funded restoration projects. In support of the floodplain project, Escambia County has, to date, acquired a total of 16 vacant parcels along Jackson Creek. Jackson Creek floodplain expansion will be accomplished, in part, by the removal of existing cul-de-sacs at the south ends of Citrus Street, Beth Circle, and Danbury Circle. The floodplain project, currently managed by the Natural Resources Management Department, will also allow for improvements to traffic flow and public safety within Wesleyan Terrace First Addition by connecting all three of the existing roadways together through an extension of Citrus Street.

There are no staff concerns about the vacation of this property. AT&T wishes to retain an easement for cables that are located in the vacation area. Pensacola Energy has existing gas mains at the end of each cul-de-sac and they feel it would be easier to reserve the easement now and work with the project to relocate or abandon the mains for the new right-of-way construction.
BUDGETARY IMPACT:

Indirect staff cost associated with the preparation of documents and Recommendation.

LEGAL CONSIDERATIONS/SIGN-OFF:

PERSONNEL:
All work associated with this request is being done in-house and no additional staff is required.
POLICY/REQUIREMENT FOR BOARD ACTION:

This Recommendation is based on the Board's Vacating, Abandoning, and Closing Existing Public Streets, Rights-of-Way, Alleyways, Roads, Highways, Other Places Used for Travel or Other Lands Dedicated for Public Use or Purposes, or Any Portions Thereof to Renounce and Disclaim Any right of the County and The Public In and To Said Lands policy for closing, vacating and abandoning County Owned property- Section III, and Florida Statues, Chapter 336.

IMPLEMENTATION/COORDINATION:

Upon Board approval of the Petition to Vacate, the necessary documents will be signed and it will be the responsibility of county staff to have them recorded in the public records and to have notices published.
