RECOMMENDATION:
Recommendation Concerning the Acquisition of Real Property Through the Defense Infrastructure Grant - Joy Jones, P.E., Engineering Department Director

That the Board take the following action regarding the acquisition of three parcels of real property through the Defense Infrastructure Grant (DIG):

A. Authorize the purchase of the following three parcels of real property;

C. Approve the Contract for Sale and Purchase between American Fidelity Life Insurance Company and Escambia County for real property (approximately 0.32 acre) located at 617 South Navy Boulevard;

D. Accept, for information, the Public Disclosure of Interest Form provided by American Fidelity Life Insurance Company, the owner of the parcel located at 615 South Navy Boulevard;

E. 
Accept, for information, the Public Disclosure of Interest Form provided by American Fidelity Life Insurance Company, the owner of the parcel located at 617 South Navy Boulevard;

F. Approve the Contract for Sale and Purchase between TWA Corp., a Delaware Corporation, and Escambia County for real property (approximately 0.47 acre) located at 613 South Navy Boulevard;

G. Accept, for information, the Public Disclosure of Interest Form provided by TWA Corp., a Delaware Corporation, the owner of 613 South Navy Boulevard; and


H. Authorize the County Attorney's Office to prepare and the Chairman or Vice-Chairman to execute any documents, subject to Legal review and sign-off, necessary to complete the acquisition of this property without further action of the Board.

[CONTRACTS FOR SALE AND PURCHASE AND PUBLIC DISCLOSURE OF INTEREST FORMS TO BE DISTRIBUTED UNDER SEPARATE COVER]
BACKGROUND:
In 2004, through land acquisition, the Board began to implement a density reduction program recommended in the Joint Land Use Study (JLUS) to combat the encroachment of residential and incompatible use on the military mission to Naval Air Station Pensacola (NASP). This program promotes flexibility for NASP to adapt training missions to meet future needs. A primary funding source for these land acquisitions is the Defense Infrastructure Grant (DIG) program administered by Enterprise Florida. The DIG program provides no-match grants to assist in meeting the needs of Florida communities hosting defense industries, bases, and installations. Escambia County has participated in this program since 2007.

The subject parcels were three of seventeen parcels targeted in coordination with the Navy to meet the goal of reducing encroachment of residential and incompatible uses within the Airfield Influence Planning District (AIPD) for NASP. The three contiguous parcels are located at 613, 615, and 617 South Navy Boulevard.

These acquisitions are time sensitive due to the expiration of Defense Infrastructure Grant (DIG) funding on June 28, 2019. Staff intended to utilize Readiness and Environmental Protection Integration Program (REPI) grant funds to address the funding shortfall; however, the REPI contracts will not be ready for Board consideration until July 2019. To meet the grant expiration timeline, LOST III funding ($142,876) could bridge the gap until the REPI funds are received, which would then be reimbursed to the Local Options Sales Tax.

In order to obtain the Restrictive Easement value, the appraiser first had to provide a value of the overall real property. The value for the property located at 613 South Navy Boulevard is listed on page five of the appraisal. The value for the properties located at 615 and 617 South Navy Boulevard is also located on page five of the appraisal; however, that is the combined value of the two parcels since they are under the same ownership. These parcels are being bought individually and the per-lot value for each parcel is located at the bottom of page 42. 
BUDGETARY IMPACT:

Fund 110, Other Grants and Projects, Cost Center 221006, $200,000; Cost Center 221015, $100,000; and Cost Center 221020, $166,124. Fund 352, LOST III, Cost Center 220102, Project 19NE4188, $142,876.

LEGAL CONSIDERATIONS/SIGN-OFF:
The County Attorney's office will prepare the closing documents and conduct the closing for the purchase of these properties. The Contracts for Sale and Purchase were approved as to form and legal sufficiency by Stephen West, Senior Assistant County Attorney.
PERSONNEL:
All work associated with this request is being done in-house and no additional staff is required.
POLICY/REQUIREMENT FOR BOARD ACTION:
These actions are consistent with the provisions of Section 46-139 of the Escambia County Code of Ordinances.
IMPLEMENTATION/COORDINATION:
Upon Board approval, staff will maintain compliance with Section 46-139 of the County Codes.
