| RECOMMENDATION: |
Recommendation Concerning FWC Agreement No. 15104-A3 (Amendment No. 3) with the Florida Fish and Wildlife Conservation Commission for the Ex-Oriskany PCB Artificial Reef Monitoring Project - J. Taylor “Chips” Kirschenfeld, Director, Department of Natural Resources Management
That the Board approve and authorize the Chairman to sign FWC Agreement No. 15104-A3 (Amendment No. 3) with the Florida Fish and Wildlife Conservation Commission (FWC), relating to the Ex-Oriskany PCB Artificial Reef Monitoring Project, which will extend the Agreement expiration date from December 31, 2019, to December 31, 2020; increase the number of individual reef fish PCB samples analyzed from 141 to 143 fish; and increase the maximum compensation from $105,750 to $107,250.

| BACKGROUND: |
The decommissioned aircraft carrier Ex-Oriskany was deployed as an artificial reef by the US Navy in May 2006. The Navy obtained a permit from US Environmental Protection Agency (USEPA) to deploy the ship in an artificial reef site permitted to Florida Fish and Wildlife Conservation Commission (FWC). US Navy's contractors could not remove all materials (paints, wiring, bulkhead insulation, etc.) containing solid-phase Polychlorinated Biphenyls (PBCs), however, the Navy's testing and analysis demonstrated to the satisfaction of USEPA that the PCBs in reef fish at Oriskany Reef would not exceed allowable levels for long-term human consumption.
A condition of the USEPA permit required FWC and Escambia County to collect reef fish from Oriskany Reef for tissue analysis for PCBs. FWC has funded the fish tissue analyses through annual artificial reef monitoring grants. FWC and Escambia County conduct annual reef fish collection and PCB tissue analysis, and provide results to USEPA and Florida Department of Health. Upon review of these data, Florida Department of Health has listed scamp and bank seabass in their Annual Fish Consumption Advisory. USEPA requested FWC develop a Tier 2 Sampling Plan. This will likely result in greater sampling costs, therefore, FWC has increased funding of the existing Agreement FWC-15104 from $105,750 to $107,250. |
