RECOMMENDATION:

Recommendation Concerning Statement of Claim filed in the County Court Case of Escambia County v. Matthew Lindsey, Case No. 2019 SC 001656.

That the Board be made aware that the County entered into the attached Mediated Agreement with respect to Mr. Matthew Lindsey’s unpaid corrections officer training expenses.

BACKGROUND:

On January 10, 2017, the County and Mr. Matthew Lindsey entered into a Contract for Reimbursement of Training Expenses. As outlined in the Contract, the County intended to employ Mr. Lindsey in the capacity of a full-time corrections officer at the Escambia County Jail. Pursuant to state statute, the County agreed to fund the costs associated with Mr. Lindsey attending the corrections officer training program, in exchange for Mr. Lindsey’s agreement to work as a corrections officer for the County for a period of two (2) years after completing the training program.

Mr. Lindsey completed the training program on April 21, 2017. On July 19, 2017, Mr. Lindsey submitted his resignation to the County, prior to completing his two (2) year commitment to the County. At the time of his resignation, Mr. Lindsey had an outstanding balance of $1,438.97 with respect to his training expenses.

On April 15, 2019, the County filed a Statement of Claim against Mr. Lindsey in the County Court, Small Claims Division. The Statement of Claim was in the principal amount of $1,438.97, plus court costs in the amount of $200.00.

On May 8, 2019, this case came before the Court for hearing, at which time a Mediated Agreement was reached between the County and Mr. Lindsey. Pursuant to the Mediated Agreement, Mr. Lindsey's total amount due to the County is $1,638.97. Mr. Lindsey will make monthly payments in the amount of $100.00 until the balance is paid in full.
