RECOMMENDATION:

Recommendation Concerning Termination of Temporary Access and Construction Easement for the Warrington Linear Park Project.

That the Board take the following action:

A. Approve the Termination of Temporary Access and Construction Easement for the Warrington Linear Park Project recorded in Official Record Book 5912 at page 1208 of the public records of Escambia County, Florida;

B. Authorize the Chairman to execute the Termination of Temporary Access and Construction Easement; and

C. Authorize staff to record it in the public records at the County's expense.

BACKGROUND:

In 2005, American Mini-Storage, Inc., conveyed to the County a Temporary Access and Construction Easement to facilitate construction of the County's Warrington Linear Park project. The easement expired at the conclusion of the Project in 2007. However, the easement was recorded in the public records and remains an encumbrance on the title of the property. American Mini-Storage, Inc. is in the process of selling its property, and its closing agent has requested that the County execute an appropriate instrument in the public records to confirm that the temporary access and Construction Easement no longer encumbers the property.

BUDGETARY IMPACT:

Funds for recording are available in the escrow account maintained by Engineering (R.E.A.D Division).

LEGAL CONSIDERATIONS/SIGN-OFF:

The County Attorney's Office has prepared the Termination of Temporary Access and Construction Easement.

The County Attorney's Office will ensure that the Termination of Termpoary Access and Construction Easement is recorded in the public records.
