RECOMMENDATION:
Recommendation Concerning the Exchange of County Property on Brickton Road - Joy Jones, P.E., Engineering Department Director

That the Board take the following action regarding the exchange of County property, for property owned by Cleveland Rufus Campbell, Sr., individually and as Trustee of the Cleveland Rufus Campbell, Sr., Revocable Trust, dated December 14, 2017:

A. Adopt a Resolution authorizing the exchange of a portion of a County-owned parcel (approximately 2.06 acres), for a portion of a parcel (approximately 3.16 acres), owned by Cleveland Rufus Campbell, Sr., individually and as Trustee of the Cleveland Rufus Campbell, Sr., Trust, dated December 14, 2017, in accordance with the terms and conditions contained in the Agreement for Sale and Purchase and Contract for Sale and Purchase;

B. Waive the retention of the fractional interest in the phosphates, minerals, metals, and petroleum in the parcel to be conveyed by the County, in accordance with Section 270.11(3), Florida Statutes;

C. Authorize the payment of documentary stamps because the property is being acquired for public use, which is for the Brickton Road right-of-way, and the public benefits from the exchange by having safer, more efficient traffic flow and improved stormwater drainage; and

D. Authorize the County Attorney's Office to prepare, and the Chairman or Vice Chairman to execute any documents, subject to Legal review and sign-off, necessary to complete the exchange of the properties, without further action of the Board.

This property exchange is located in District 5.
BACKGROUND:
In 2002, Escambia County paved Brickton Road under the Dirt Road Paving Program. In 2015, an error was discovered in the legal description of what was conveyed to the county versus what was paved as Brickton Road. Mr. Campbell is conveying to the county the area that was actually paved so that the existing paved road is located in the dedicated right-of-way. The county is conveying back to Mr. Campbell the area in the previously-described right-of-way, which is actually located on Mr. Campbell's property.
BUDGETARY IMPACT:

Funds for incidental expenses associated with the recording of documents are available in an Engineering Escrow Account accessed by the Escambia County Clerk's Office.

LEGAL CONSIDERATIONS/SIGN-OFF:
The Agreement for Sale and Purchase and the Contract for Sale and Purchase were approved as to form and legal sufficiency by Stephen West, Assistant County Attorney.
PERSONNEL:
All work associated with this request is being done in-house and no additional staff is required.
POLICY/REQUIREMENT FOR BOARD ACTION:
Upon Board approval, county staff will proceed in compliance with Section 46-139 of the Escambia County Code of Ordinances.
IMPLEMENTATION/COORDINATION:
Upon Board approval, the executed Warranty Deed will be recorded in the public records of Escambia County, Florida.
