RECOMMENDATION:
Recommendation Concerning a Resolution Adopting the Escambia County Area Transit Authority Substance Abuse Management Policy - Mike Crittenden, Mass Transit Department Director

That the Board take the following action:

A. Rescind the Board’s prior action of February 7, 2019, adopting the Resolution [R2019-14] adopting the Escambia County Area Transit Authority Anti-Drug Use and Alcohol Misuse Policy; 

B. Adopt the Resolution adopting the Escambia County Area Transit Authority Substance Abuse Management Policy; and

C. Authorize the Chairman to sign the Resolution.
BACKGROUND:
Pursuant to 49 C.F.R. Part 655, the Federal Transit Administration (FTA) of the U.S. Department of Transportation (USDOT) requires recipients of federal transportation assistance to adopt a policy establishing an anti-drug use and alcohol misuse program that includes urine drug testing and breath alcohol testing for employees performing safety-sensitive functions.  The collection and testing of urine and breath specimens must comply with the USDOT drug and alcohol testing requirements set forth in 49 C.F.R. Part 40.  In addition, under the Drug-Free Workplace Act of 1988 (41 U.S.C. §§8101-8106), Federal grantees are required to establish drug-free workplace policies and report certain drug-related offenses to the granting agency. 
 
After adopting the previous Resolution and corresponding Policy, the Florida Department of Transportation advised ECAT to utilize one of two FTA-compliant policy templates to ensure compliance with recent amendments to FTA and USDOT regulations.  The Policy has been revised accordingly.

This Resolution will serve as documentation of the Board’s formal adoption of the required Substance Abuse Management Policy for ECAT employees performing safety-sensitive functions.
