Issue:    Acquisition of Real Property located at 7320 Hayward Avenue for the Muldoon-Cerney-Velma-Fresno Area Drainage Project

RECOMMENDATION:
Recommendation Concerning the Authorization for Acquisition of Property Located at 7320 Hayward Avenue - Joy Jones, P.E., Engineering Department Director

That the Board take the following action regarding the acquisition of real property located at 7320 Hayward Avenue (14.1 acres more or less), from Escambia Gulf Coast Pits, LLC, a Florida Limited Liability Company: 

A. Authorize the purchase of real property located at 7320 Hayward Avenue (14.1 acres more or less) from Escambia Gulf Coast Pits, LLC, a Florida Limited Liability Company, for the purchase price of $240,000 (appraised value);   

B. Approve the Contract for Sale and Purchase for the acquisition of real property located at 7320 Hayward Avenue (14.1 acres more or less);  

C. Accept the Public Disclosure of Interest Form from Escambia Gulf Coast Pits, LLC; and

D. Authorize the County Attorney's Office to prepare, and the Chairman or Vice Chairman to execute, subject to Legal review and sign-off, any documents necessary to complete the acquisition of this property without further action of the Board.

This project is located in Commission District 1.

BACKGROUND:
The Hayward property is located next to an existing County pond (Velma Pond 92) that needs to be expanded to improve capacity and positive outfall issues. The Bayou Marcus Master Drainage Plan outlined a drainage concept for this area. This proposed pond on the Hayward property combined with the existing Velma Pond parcel would provide for a more cost-effective drainage system than the one identified and proposed in the Master Plan by considerably reducing the outfall pipe size.  Engineering is currently drafting a scope of work for solicitation of design services for the Muldoon-Saufley Field-Cerney-Velma-Fresno Area Drainage project, for which the acquisition of this parcel is a key component. Funding for acquisition and design is in LOST III and construction is programmed in LOST IV (FY2020 and FY2027).
BUDGETARY IMPACT:

Funding for this project is available in Fund 352, LOST III, Cost 210107, Object Code 56101, Project #17EN2791.

LEGAL CONSIDERATIONS/SIGN-OFF:
The County Attorney's office will prepare the closing documents and conduct the closing for the purchase of this property. The Contract for Sale and Purchase was approved as to form and legal sufficiency by Stephen West, Assistant County Attorney, on November 19, 2018. 
PERSONNEL:
All work associated with this request is being done in-house and no additional staff is required.
POLICY/REQUIREMENT FOR BOARD ACTION:
These actions are consistent with the provisions of Section 46-139 of the Escambia County code of Ordinances.
IMPLEMENTATION/COORDINATION:
Upon Board approval, staff will maintain compliance with Section 46-139 of the County Codes.
