RECOMMENDATION:
Recommendation Concerning the Acceptance of an Easement Located at the End of Crooked Oak Drive - Joy Jones, P.E., Engineering Department Director

That the Board take the following action concerning the acceptance of an easement at the end of Crooked Oak Drive from Robert J. Jones, as Personal Representative of The Estate of Olga F. Jones:

A. Accept the donation of a drainage easement, (approximately 0.401 acres) located at the end of Crooked Oak Drive from Robert J. Jones, as Personal Representative of The Estate of Olga F. Jones, for drainage improvements;

B. Authorize the payment of documentary stamps considering the property is being donated for governmental use for drainage improvements, and the County benefits from the acceptance of this property, which enhances the safety and well-being of the citizens of Escambia County;

C. Authorize the payment of incidental expenditures associated with the recording of documents; and

D. Authorize the Chairman or Vice Chairman to accept the Easement on the day of delivery of the Easement to the Chairman or Vice Chairman, and authorize the Chairman or Vice Chairman to acknowledge the Board's acceptance at that time.

This property is located in Commission District 5.

BACKGROUND:
Motley Court Creek Gulley Project is a drainage way that starts at the North end of Motley Court, along the East boundary of Boulder Creek 1st Addition subdivision and extends to Clear Creek. This open ditch has eroded into a meandering gulley, ranging in varying widths of 10’-40’ wide, depths of 3’ to 20’ deep, and extends into the University of West Florida property and the privately-owned Jones property. Meeting in regular session on September 21, 2017, the Board authorized submittal of the Motley Court Clear Creek Gulley project to the National Resources Conversation Service (NRCS) Emergency Watershed Protection (EWP) Program for consideration of grant eligibility and funding under the EWP. NRCS has since presented a grant agreement to Escambia County to address improvements within the gulley. At an additional regularly-scheduled meeting on June 21, 2018, the Board authorized the County Administrator to sign all necessary forms and for County staff to initiate acquisition activities as necessary to proceed with the project. Mr. Robert J. Jones has agreed to grant the County this Easement to proceed with this project.

An additional easement will be needed from the University of West Florida, which will be brought to the BCC at a later date. 

HDR Engineering is ready to submit final design after Jones and University of West Florida acquisitions are complete. We are awaiting their bid package to send to purchasing.

BUDGETARY IMPACT:
Funds for incidental expenses associated with the recording of documents are available in an Engineering Escrow Account accessed by the Escambia County Clerk's Office.
LEGAL CONSIDERATIONS/SIGN-OFF:
The Drainage Easement was approved as to form and legal sufficiency by Stephen West, Assistant County Attorney, on January 8, 2019. 
PERSONNEL:
All work associated with this request is being done in-house and no additional staff is required.
POLICY/REQUIREMENT FOR BOARD ACTION:
These actions are consistent with the provisions of Section 46-139 of the Escambia County Code of Ordinances. 
IMPLEMENTATION/COORDINATION:
Upon Board approval, staff will have the executed Drainage Easement recorded in the public records of Escambia County, Florida.
