RECOMMENDATION:
Recommendation Concerning an Agreement of Purchase and Sale of Mitigation Credits for the Willowbrook Lake Dam Project - Joy D. Blackmon, P.E., Public Works Department Director

That the Board take the following action concerning an Agreement of Purchase and Sale of Mitigation Credits for the Willowbrook Lake Dam Project located on Chemstrand Road:

A. Approve the Agreement between Escambia County and Westervelt Ecological Services, LLC, a Delaware limited liability company;

B. Authorize the Chairman or Vice Chairman to execute the Agreement, and all other documents related to the conveyance, subject to Legal review and sign-off, without further action of the Board;

C. Direct staff to move ahead with mitigation; and

D. Approve funds, in the amount of $71,550, for the purchase of the Mitigation Credits.

BACKGROUND:
Willowbrook Lake was built in the late 1950’s when Willowbrook Subdivision was established. The dam to Willowbrook Lake not only retained water for the residents to have lakefront property, but also functioned as a means of treatment of stormwater from the surrounding basin.
 
During the April 2014 Rainfall Event, water breached the dam and caused extensive damage to the structure and to Chemstrand Road.
 
While the project was in the design and permitting phase, wetlands in the bottom of the lake naturally reestablished. Because of this, the conditions of Army Corps of Engineers (ACOE) permit require the County to purchase upland credits to compensate for wetland impacts that will occur with these improvements.
 
Once the County purchases the mitigation credits, reconstruction of the dam can occur, and the lake area will again manage runoff and provide stormwater treatment for approximately 1,200 acres that will outfall into Clear Creek, and eventually Escambia River.
 
The design is scheduled to be complete by March 31, 2018. 
BUDGETARY IMPACT:
Funds for the mitigation credits are available in Fund 352 "LOST III", Cost Center 210107, Object Code 56301, Project #15EN3325.
