RECOMMENDATION:
5:33 p.m. Public Hearing for consideration of the Petition to Vacate a portion of the Huntington Creek First Addition Plat, as petitioned by Clearwater 102, LLC. 

Recommendation: That the Board take the following action regarding a Petition to Vacate a portion of a subdivision:

A. Approve or deny the Petition to Vacate a portion of Huntington Creek First Addition Plat, a subdivision recorded in Plat Book 19, Pages 34 and 34A, as petitioned by Clearwater 102, LLC; 

B. Accept the Hold Harmless Agreement;

C. Adopt the Resolution to Vacate; and

D. Authorize the Chairman or Vice Chairman to accept the documents as of the day of delivery of the documents to the Chairman or Vice Chairman, and authorize the Chairman of Vice Chairman to execute them at that time.
BACKGROUND:
Due to an oversight by Clearwater 102, LLC, their attorney, and their surveyor, a portion of the land owned by Clearwater 102, LLC, was dedicated to the Homeowners Association in the platting of Huntington Creek Phase I. The Homeowners Association deeded back to Clearwater 102, LLC, that portion of land as described in Official Records Book 7788, Page 209 (F-1) of the Public Records of Escambia County, Florida. All easements remain dedicated to Huntington Creek Phase I.

The purpose of this Petition to Vacate is to allow the lot owners in the proposed Subdivision Plat of Huntington Creek Phase II to retain individual lot ownership to the right of way of the private roadway being Huntington Creek Boulevard, with all easements remaining in place, as called for and platted in Phase I (the Petition to Vacate being for a portion of the first addition.)

The Vacation will not deny convenient access to any persons owning property within the area of said vacation. All easements granted in the first addition will remain in place.

Notifications were sent to all property owners within a 500-foot radius, as well as all property owners within the Huntington Creek and Twin Spires Subdivisions.
BUDGETARY IMPACT:
Indirect staff cost associated with the preparation of documents and recommendation.

PERSONNEL:
All work associated with this request is being done in-house and no additional staff is required.
POLICY/REQUIREMENT FOR BOARD ACTION:
Based on the Board’s Subdivision Plat Vacation Procedures - Section III(A) and Florida Statues, Chapter 177
IMPLEMENTATION/COORDINATION:
Upon Board approval of the Petition to Vacate, the necessary documents will be signed and delivered to the Petitioner or to the Petitioner's agent, who will have the documents recorded in the public records and to advertise the required public notifications.
