RECOMMENDATION:

Recommendation Concerning the Sovereignty Submerged Lands Easement with the Board of Trustees of the Internal Improvement Trust Fund of the State of Florida Relating to Macky Island - J. Taylor "Chips" Kirschenfeld, Director, Department of Natural Resources Management

That the Board approve and authorize the Chairman to sign the Sovereignty Submerged Lands Easement with the Board of Trustees of the Internal Improvement Trust Fund of the State of Florida relating to Macky Island.

BACKGROUND:

As the Local Sponsor for the dredging of the federal navigational channel in Escambia Bay and Escambia River, Escambia County is responsible for providing a site for disposal of dredged sediments. Escambia County staff worked with US Army Corps of Engineers (ACOE) and Florida Department of Environmental Protection (FDEP) to find a suitable site at Macky Island. FDEP confirmed the island is owned by the State of Florida, therefore, requires the county obtain an Easement to allow ACOE to use the site for disposal of dredged materials.

BUDGETARY IMPACT:

There is no budgetary impact associated with this recommendation.

LEGAL CONSIDERATIONS/SIGN-OFF:

The Sovereignty Submerged Lands Easement was reviewed by Senior Assistant County Attorney Stephen G. West. He noted that he reviewed neither the legal description nor attachments to the Easement.

PERSONNEL:

No additional impact to personnel associated with this recommendation.

POLICY/REQUIREMENT FOR BOARD ACTION:

Board Policy II.B.8.

IMPLEMENTATION/COORDINATION:

Department of Natural Resources Management's Marine Resources Division will be responsible for implementation and coordination.
