RECOMMENDATION:
November 14, 2017, communication from realtor John O’Donnell on behalf of property owners Heang Long and Dung Ngoc Ly regarding a Municipal Services Benefit Unit (MSBU) non-ad valorem tax assessment on their property located at 2215 West Brainerd Street.  The MSBU tax assessment is in the amount of the abatement costs the County incurred to remove nuisance conditions on the property prior to the transfer of title to Heang Long and Dung Ngoc Ly.

POLICY/REQUIREMENT FOR BOARD ACTION:
Unlike requests for relief from daily fines under liens created by the Special Magistrate under Chapter 30 and governed by the Board’s Guidelines for Relief from Environmental (Code) Enforcement Special Magistrate Liens, Section III, Part H.2, amended June 2, 2015, this written communication involves an MSBU non-ad valorem tax assessment for the County’s actual cost of abating nuisance conditions pursuant to Code Section 42-165. All procedures in Section 42-165 for imposing MSBU tax assessments were properly executed by Code Enforcement.
