RECOMMENDATION:

Recommendation Concerning the Scheduling of a Public Hearing to Consider Amending Chapter 30 and Chapter 42 of the Escambia County Code of Ordinances Relating to Code Enforcement Liens.

That the Board authorize the scheduling of a Public Hearing for January 4, 2018, at 5:31 p.m. to consider amending the lien and MSBU provisions in Chapter 30 and Chapter 42 of the Escambia County Code of Ordinances to ensure consistency with judicial determinations relating to lien priority and to clarify the procedures relating to summary abatement and MSBU tax assessments.

BACKGROUND:

Since adoption of the superpriority lien provisions in Chapter 30 and Chapter 42 of the Escambia County Code of Ordinances, Florida courts have determined that such superpriority lien status is unenforceable. Also, clarification of the procedures establishing summary abatement liens and MSBU tax assessments in Chapter 42 will better distinguish the two enforcement mechanisms and ensure that appropriate record notice provisions are incorporated where applicable.

The ordinance was drafted by Assistant County Attorney Bobbie Ellis-Wiggins and will be advertised in the Pensacola News Journal on Saturday, December 23, 2017.
