RECOMMENDATION:
Recommendation Concerning the Memorandum of Understanding Relating to the Installation and Maintenance of Ornamental Roadway Signage within the Windsong Subdivision - Joy D. Blackmon, P.E., Public Works Department Director

That the Board approve and authorize the Chairman to sign the Memorandum of Understanding Relating to the Installation and Maintenance of Ornamental Roadway Signage within the Windsong Subdivision.
BACKGROUND:
The Homeowners Association (HOA) has agreed to install and maintain ornamental roadway signage on county rights-of-way within the boundaries of the Windsong Subdivision. The HOA and Escambia County have determined it is in the best interest of the citizens to enter into this Agreement setting forth the parties' respective responsibilities.   

The HOA agrees to install and maintain all necessary roadway signage and sign posts on county rights-of-way within the boundaries of the Windsong Subdivision. The HOA may install non-standard, ornamental sign posts with the prior approval of the county, and the county shall retain the right to reject, for any reason, a proposed design, sign assembly, and/or location. 

The HOA shall immediately notify the Escambia County Transportation & Traffic Operations Office (850-595-3404) of any damaged or destroyed signage and/or sign posts, and further agrees to promptly repair or replace any damaged or destroyed non-standard signage and/or sign posts at the HOA's expense within 24 hours. The HOA shall also remove and/or dispose of any related debris at the HOA's expense within 24 hours, or sooner if hazardous to the public. 

Prior to initial installation or any subsequent re-installation of non-standard sign posts and/or signage, the HOA shall be responsible for obtaining all necessary permits from the county at the HOA's own expense, including but not limited to all applicable fees, costs, and permit charges regularly assessed by the county. 

The HOA may terminate this Agreement upon providing at least thirty (30) days' prior written notice of such request to the county. The county reserves the right to immediately terminate this Agreement at any time with or without cause upon providing written notice to the HOA.

IMPLEMENTATION/COORDINATION:
Upon approval, Escambia County Transportation & Traffic Operations staff will continue to work with the Windsong Subdivision HOA.
