RECOMMENDATION:
Recommendation Concerning the Review of an Interlocal Agreement for Airport Hazard and Incompatible Land Use Zoning

That the Board of County Commissioners (BCC) review and authorize the Chairman to sign the interlocal agreement for airport hazard and incompatible land use zoning, pursuant Chapter 333, Florida Statutes, between Escambia County and the City of Pensacola.
BACKGROUND:
F.S. 333.03 requires that every political subdivision having an airport hazard area within their territorial limits shall adopt, administer, and enforce, airport protection zoning regulations for such airport hazard area. If an airport is owned or controlled by a political subdivision and if any other political subdivision has land upon which an obstruction may be constructed or altered which underlies any surface of the airport as provided in 14 C.F.R. part 77, sub-part C, the political subdivisions shall either by interlocal agreement, adopt, administer, and enforce a set of airport protection zoning regulations.
BUDGETARY IMPACT:
No budgetary impact is anticipated by the approval of the agreement.
LEGAL CONSIDERATIONS/SIGN-OFF:
The attached interlocal agreement has been reviewed and approved for legal sufficiency by Meredith D. Crawford, Assistant County Attorney. Any recommended legal comments are attached herein.
PERSONNEL:
No additional personnel are required for implementation of this action.
POLICY/REQUIREMENT FOR BOARD ACTION:
That the Board approve the draft interlocal agreement for execution.
IMPLEMENTATION/COORDINATION:
The proposed agreement was prepared by the City of Pensacola in cooperation with Development Services and the County Attorney's Office.
