RECOMMENDATION:
5:32 p.m. Public Hearing for consideration of the vacation of a portion of Semmes Street.

Recommendation: That the Board take the following action concerning the vacation of a Portion of Semmes Street:
  
A. Approve or deny the vacation of a portion (approximately 66 feet X 690 feet) of Semmes Street, as petitioned by GPD, subject to a utility easement being retained over said right of way requesting to be vacated;

B. Accept the Hold/Harmless Agreement;

C. Adopt the Resolution to Vacate; and

D. Authorize the Chairman or Vice Chairman to accept the documents as of the day of delivery of the documents to the Chairman or Vice Chairman, and authorize the Chairman or Vice Chairman to execute them at that time.
BACKGROUND:
The petitioner, GPD, is requesting to vacate a portion of Semmes Street right-of-way, approximately 66' x 690', just south of the Perdido Gardens development project, of which GPD is the owner.

Semmes Street is located in the Perdido Key area and runs east and west from River Road and meanders back to Perdido Key Drive. However, the right of way of Semmes Street is not consistent due to a previously-approved vacation request (August 19, 2004) when WCI petitioned the Board of County Commissioners to vacate approximately 3.26 acres of Semmes Street right of way. This previously-vacated portion is directly east of the portion of Semmes Street addressed in this petition. 

There are no encroachment issues involved with this vacation of right of way request.  Staff has reviewed the request and has no objection to the vacation of right of way. All utility companies have reviewed the request, and three utility companies (ECUA, Gulf Power and Energy Services of Pensacola) have requested to retain an easement.

It does not appear that anyone would be denied access to his or her property should this request be granted.

Notifications were sent to the surrounding property owners within a 500' radius.
BUDGETARY IMPACT:

Indirect staff cost associated with the preparation of documents and recommendation.

LEGAL CONSIDERATIONS/SIGN-OFF:

N/A

PERSONNEL:
All work associated with this request is being done in-house and no additional staff is required.
POLICY/REQUIREMENT FOR BOARD ACTION:

This recommendation is based on the Board's Vacating, Abandoning, and Closing Existing Public Streets, Rights-of-Way, Alleyways, Roads, Highways, Other Places Used for Travel or Other Lands Dedicated for Public Use or Purposes, or Any Portions Thereof to Renounce and Disclaim Any right of the County and The Public In and To Said Lands policy for closing, vacating and abandoning County Owned property- Section III, and Florida Statues, Chapter 336.

IMPLEMENTATION/COORDINATION:

Upon Board approval of the Petition to Vacate, the necessary documents will be signed and delivered to the Petitioner or the Petitioner's agent, who will have them recorded in the public records and will have notices published.
