RECOMMENDATION:
Recommendation Concerning the Acceptance of Declaration of Restrictive Covenants for County-Owned Property for Well Line Road Extension Project - Joy D. Blackmon, P.E., Public Works Department Director

That the Board take the following action concerning the acceptance of the Declaration of Restrictive Covenants for County-Owned Property, located off Saufley Field Road, as mitigation for the Well Line Road Extension Project:

A. Approve and authorize the Chairman or Vice Chairman to execute the Declaration of Restrictive Covenants as of the day of delivery to the Chairman or Vice Chairman, and authorize the Chairman or Vice Chairman to acknowledge the Board's acceptance at that time; and

B. Authorize the payment of incidental expenditures associated with the recording of documents.

BACKGROUND:
As part of the Well Line Road Extension Project, wetland mitigation needed to be addressed and there are currently no mitigation banks in the area of Well Line Road that could have been utilized. Escambia County owns two parcels located off of Saufley Field Road that can be used as mitigation to obtain a permit for the wetland impacts on Well Line Road. Northwest Florida Water Management District (NWFWMD) can issue a permit for the construction of Well Line Road; however, Board acceptance and approval is required to authorize staff to proceed with Declaration of Restrictive Covenants. This agreement will authorize substitution of the requirement of transferring the property to NWFWMD. Escambia County will retain ownership of the two parcels (approximately 36.06 acres), which are already surrounded on three sides by NWFWMD property. The property will remain undeveloped, pursuant to the Florida Defense Alliance/Defense Infrastructure Grant agreement.

By agreeing to and approving the Declaration of Restrictive Covenants, the County does not have to purchase any additional property for mitigation of the wetland impacts for this project. This does not, however, include any impacts that may happen during the private development of the remaining property in the area of the road extension. 

Negotiations for additional services through Atkins Global to complete the design of Phases I and II are underway. Negotiations expect to be completed in August 2017.

LEGAL CONSIDERATIONS/SIGN-OFF:
The Declaration of Restrictive Covenants was approved as to form and legal sufficiency by Stephen West, Assistant County Attorney.
PERSONNEL:
All work associated with this request is being done in-house and no additional staff is required.
POLICY/REQUIREMENT FOR BOARD ACTION:
Upon Board approval, County staff will proceed in compliance with Section 46-139 of the Escambia County code of Ordinances.
IMPLEMENTATION/COORDINATION:
Upon board approval, staff will have the Declaration of Restrictive Covenants recorded in the public records of Escambia County, Florida.
