Recommendation Concerning Contract Award for Beach Haven Northeast Drainage and Sanitary Sewer Project, Phase I - Claudia Simmons, Office of Purchasing, Purchasing Manager

That the Board take the following action:

A. Approve and authorize the County Administrator to sign the Agreement between Escambia County, Florida, and Phoenix Construction Services, Inc., per the terms and conditions of PD 15-16.94, Beach Haven Northeast Drainage and Sanitary Sewer Project, Phase I, for a lump sum of $10,497,122.21;

B. Approve Amendment No. 1 to the lnterlocal Cost-Sharing Agreement between the Emerald Coast Utilities Authority (ECUA) and the County of Escambia for construction services for the Beach Haven Northeast Drainage, Roadway, and Sanitary Sewer Improvement Project Phase 1; and

C. Authorize the Chairman or Vice Chairman to sign the amended Interlocal Cost-Sharing Agreement.

BACKGROUND:
The Beach Haven Drainage and Sanitary Sewer Project is a joint project between Escambia County and the Emerald Coast Utilities Authority (ECUA), to be managed by Escambia County Engineering Division of Public Works, for providing enhanced stormwater improvements and sanitary sewer services to all lots located in the Beach Haven neighborhood. The project will be completed in phases. Phase I project boundaries extend from Gulf Beach Highway on the south to Jones Swamp on the north, Decatur Avenue on the West and Mills Avenue on the East, excluding a portion of Bartow Avenue north of Eliasburg Street as this area was upgraded with stormwater improvements in late 2011.
 
The County’s intended scope of this project include drainage enhancements to the existing drainage system within the project area, removal of unsafe deep roadside ditches, prevent roadway and adjacent lot flooding, prevent roadside shoulder ponding, provide dirt road paving improvements to North Street, provide roadway connectivity between roadways or otherwise cul-de-sacs at roadway terminations, provide roadway reconstruction & resurfacing improvements as adjacent roadways are impacted by the construction, and provide sanitary sewer services as directed by ECUA with elimination of septic tanks and associated drain fields.
 
It is the intent of ECUA to provide sanitary sewer services to all lots within the subject project area.

At the regular scheduled Board of County Commissioners meeting on August 4th, 2016, the board approved an Interlocal Cost Sharing Agreement with ECUA to provide a funding budget for the sanitary sewer portions of the project, so the project funding was available for bid. The cost sharing percentages in the agreement were based upon estimates of construction costs, and expected costs sharing line items to be reimbursed by ECUA during construction. After the bids were opened, staff meet with ECUA staff to review cost sharing line items, costs sharing percentages, and bid costs, resulting in a necessary Amendment No. 1 of the Interlocal Cost Sharing Agreement. Amendment No 1 reflect accurate percentages, based upon actual bid costs, and as required to correct cost sharing percentages of which ECUA is responsible for reimbursement to the County, as compared to the original estimates. ECUA's board consideration for Amendment No 1 was scheduled for October 27, 2016.

The legal advertisement for this "Invitation to Bid" was advertised in the Pensacola News Journal on Monday's, August 22, 2016 and August 29, 2016. A Mandatory Pre-Solicitation Conference was held on Wednesday, August 31, 2016. Fourteen firms were represented at that meeting. Bids were received from three contractors on Wednesday, September 21, 2016. Phoenix Construction Services, Inc. is the low bidder.

No budgetary impact exists.  ECUA will reimburse the County for sanitary sewer construction costs incurred and invoiced, as outlined in Amendment 1 Interlocal Cost Sharing Agreement.

Amendment No. 1 was reviewed and approved by Stephen West, County Attorney, on October 6, 2016.
PERSONNEL:
All work associated with this recommendation was done in-house and no additional staff was required.
POLICY/REQUIREMENT FOR BOARD ACTION:
This recommendation is in compliance with the Code of Ordinances of Escambia County, FL 1999, Chapter 46, Finance, Article II Purchases and Contracts.

§163.01, Florida Statutes, grants the Board authorization to enter into lnterlocal Agreements.
IMPLEMENTATION/COORDINATION:
The Office of Purchasing will issue the Attorney's Standard Form of Contract Form D: Road/Drainage and Purchase Order.

Upon approval by the BCC, implementation of the project will be a coordinated effort between John Seymour, Manager of Engineer Projects (ECUA), Stormwater Engineer Manager, Chris Curb (Escambia County), and/or Terri Berry, Project Coordinator (Escambia County).
