RECOMMENDATION:
Recommendation Concerning the Acquisition of Real Property for the Detroit Boulevard and Cove Avenue Bridge Replacements Project - Joy D. Blackmon, P.E., Public Works Department Director

That the Board take the following action regarding the acquisition of a parcel of real property located in the 8400 Block of Cove Avenue (approximately 1.16 acres), from Amy Bloodsworth Mims for the Detroit Boulevard and Cove Avenue Bridge Replacements Project:

A. Authorize the purchase of a parcel of real property located in the 8400 Block of Cove Avenue (approximately 1.16 acres), from Amy Bloodsworth Mims for the purchase price of $13,900, in accordance with the terms and conditions contained in the Contract for Sale and Purchase;

B. Authorize the Chairman to sign the Contract for Sale and Purchase for the acquisition of a parcel of real property located in the 8400 Block of Cove Avenue (approximately 1.16 acres); and

C. Authorize the County Attorney's Office to prepare and the Chairman or Vice Chairman to execute any documents, subject to Legal review and sign-off, necessary to complete the acquisition of this property without further action of the Board.

BACKGROUND:
The County is currently designing safety improvements along Detroit Boulevard. As part of the safety improvements, the County will be replacing the bridges on Detroit Boulevard and Cove Avenue. The new bridges will offer wider shoulders and a pedestrian path on the north side of Detroit Boulevard, and wider shoulders with provisions for future pedestrian access on Cove Avenue. Due to limited right-of-way within this area, property must be acquired from Mrs. Mims for the project to be constructed. When Mrs. Mims was contacted regarding the property the County required for right-of-way, Mrs. Mims asked if the County would purchase the entire parcel. It was determined by staff that it would be beneficial to the County to purchase the entire parcel for drainage purposes, which also has an existing Florida Department of Transportation Drainage Easement through the center of the parcel, over Eight Mile Creek. The location of the easement in the center of the parcel would also limit improvement options for the current owner. 

Upon review by the County Surveyor, Danny Swain, a significant hiatus was discovered between Mrs. Mims' property and the adjacent parcel.  Ownership and title to the hiatus could not be determined, and the County's title company would not issue a commitment for a policy on the hiatus. The contract states that Mrs. Mims will convey whatever interest she has in the hiatus, if any, by quitclaim deed. However, the County will have no assurance after closing that it has any interest in the hiatus. The County may have to take additional steps after closing, including exercise of its power of eminent domain, to resolve the title to the hiatus. 
BUDGETARY IMPACT:

Funding for this project is available in Fund 352, "Local Option Sales Tax", Account 210107/56301/56101, Project 13EN2188.

LEGAL CONSIDERATIONS/SIGN-OFF:
The County Attorney's Office will prepare the closing documents and conduct the closing for the purchase of the property.  The Contract for Sale and Purchase was approved as to form and legal sufficiency by Stephen West, Senior Assistant County Attorney.
PERSONNEL:
All work associated with this request is being done in-house and no additional staff is required.
POLICY/REQUIREMENT FOR BOARD ACTION:
These actions are consistent with the provisions of Section 46-139 of the Escambia County code of Ordinances.

 
IMPLEMENTATION/COORDINATION:
Upon Board approval, staff will maintain compliance with Section 46-139 of the County Codes.
