RECOMMENDATION:

5:31 p.m. Hearing to consider Donna Jenkins' Appeal of the Escambia County Contractor Competency Board's Decision.

Recommendation: That the Board uphold the Contractor Competency Board's decision of June 1, 2016, whereby it found Respondent, Thimothy Sowell, d/b/a Sowell Roofing Company, Inc., not in violation of any Code and dismissed Ms. Donna Jenkins' Complaint for lack of evidence to the Contrary.

BACKGROUND:

The above referenced case is a licensed contractor complaint originally filed on August 10, 2015 and dismissed on February 3, 2016 against Respondent, Thimothy Sowell d/b/a Sowell Roofing Company, Inc. Ms. Donna Jenkins, Complainant/Homeowner, contested the February 3, 2016 decision of the Contractor Competency Board to the Board of County Commissioners and the case was subsequently remanded back to the Contractor Competency Board to be reheard. Ms. Jenkins is contesting the June 1, 2016 decision of the Contractor Competency Board wherein it found lack of probable cause that the Respondent violated a Code or Statute. The Board announced its decision to dismiss the case after additional evidence and testimony were presented. The Board found that the Respondent was not required to pull a permit. Based on the foregoing, the work did not require an inspection and no proven Code violation exists.

The Complainant/Homeowner, Donna Jenkins, is seeking an appeal of the Contractor Competency Board's decision on June 1, 2016.
