RECOMMENDATION:
Recommendation Concerning Acceptance of the Deepwater Horizon Operation and Maintenance Grant Agreement for Property Located at 5806 Bob O Link Road (Innerarity Point Park) - Michael E. Rhodes, Parks and Recreation Department Director 

That the Board approve and authorize the Chairman or Vice Chairman to sign the Deepwater Horizon Operation and Maintenance Grant Agreement, No. OGC 114, between the State of Florida Department of Environmental Protection and Escambia County for property located at 5806 Bob O Link Road (Innerarity Point Park), in accordance with the terms and conditions contained in the Agreement.

BACKGROUND:
Escambia County was selected to receive funding through Phase V of the Natural Resources Damage Assessment (NRDA) process whose goal is "to enhance public access to natural resources and increase recreational opportunities." The selected project includes the acquisition of a 3.38 acre property at 5806 Bob O Link Road, development of amenities, and funds to provide ten years of operation and maintenance costs. The total value of the park and ten years of maintenance is estimated to be $6.35 million. The site is adjacent to the Galvez boat ramp to the west.

The Trust for Public Lands is tasked with acquiring the property, site design, site development, and donating the final product to Escambia County. The Florida Department of Environmental Protection is offering this Agreement to provide ten years of operation and maintenance funding ($605,000.00). Upon approval of the Board of County Commissioners, the Florida Department of Environmental Protection and Escambia County will enter into this Operation and Maintenance Agreement to assure that the property located at the Innerarity Point Park (5806 Bob O Link Road) will be operated and maintained by Escambia County to provide passive use recreational opportunities for the benefit of the public.
BUDGETARY IMPACT:
The County will receive the park after it is acquired and fully developed. At that time, a cost center will be established in Fund 118, Gulf Coast Restoration Fund and increase that fund by $605,000.00. After the initial ten years of operations and maintenance funding runs out, the County will be responsible for ongoing park maintenance.
LEGAL CONSIDERATIONS/SIGN-OFF:
The County Attorney's Office has reviewed and approved the Deepwater Horizon Operation and Maintenance Grant Agreement No. OGC 114.
PERSONNEL:
All work associated with this request is being done in-house and no additional staff is required.
POLICY/REQUIREMENT FOR BOARD ACTION:
N/A
IMPLEMENTATION/COORDINATION:
Upon Board approval, staff will maintain compliance with Section 46-139 of the County Codes.
