RECOMMENDATION:

June 23, 2016, Communication from William D. Stokes, Attorney for Deancurt Pensacola, LLC, requesting a revised Resolution releasing any County interest retained in the property under the mortgage and accompanying bond trust indenture.

Recommendation: That the Board review and consider adopting, subject to Legal review and sign-off, a revised Resolution that omits approximately 160 pages of the documents that were included in "Exhibit 1" to the original Resolution approved May 19, 2016, which are prohibitively expensive for the owner to record.

BACKGROUND:

At the May 19, 2016, BCC meeting, the Board approved a Resolution releasing any interest that the County retained in the property known as Lamplighter Apartments.

BUDGETARY IMPACT:

There will be no cost to the County, as the property owner will be responsible for all Clerk's recording fees.

LEGAL CONSIDERATIONS/SIGN-OFF:

Stephen G. West, Senior Assistant County Attorney, has approved the form of the revised Resolution.
