Issue:    Acceptance of a Portion of a Parcel of Property for Road Right-of-Way on Marge Lane

RECOMMENDATION:
Recommendation Concerning the Acceptance of a Portion of a Parcel of Property for Road Right-of-Way on Marge Lane - Joy D. Blackmon, P.E, Public Works Department Director

That the Board take the following action concerning the acceptance of the donation of a portion of a parcel of property for road right-of-way on Marge Lane from Jason L. and Catherine Shawn Flory:

A. Authorize staff to negotiate and resolve any matters related to or associated with the acceptance of the property, via donation, for road right-of-way on Marge Lane from Jason L. and Catherine Shawn Flory;

B. Authorize the payment of documentary stamps because the property is being donated for governmental use, which is for road right-of-way, and the County benefits from the acceptance of the property because it facilitates the construction and maintenance of paving and drainage systems for use by the citizens of Escambia County;

C. Authorize the payment of incidental expenditures associated with the recording of documents; and

D. Authorize the Chairman or Vice Chairman to accept the Quit Claim Deed as of the day of delivery of the Quit Claim Deed to the Chairman or Vice Chairman, and authorize the Chairman or Vice Chairman to acknowledge the Board's acceptance at that time.

BACKGROUND:
Marge Lane is a county-maintained road located off of County Road 95A. The pavement extends through a parcel of property owned by Jason and Catherine Flory, and is currently being maintained by Escambia County via maintenance claim. The property owners have requested that the county accept the parcel within which the road lies. With county acceptance of this parcel, adjoining property owners will have frontage on a county-owned right-of-way.

The property owners conducted their own survey which shows the portion of Marge Lane to be Parcel "B" within Exhibit "A" of the Quit Claim Deed.
BUDGETARY IMPACT:
Funds for incidental expenses associated with recording of documents are available in an Engineering Escrow Account accessed by the Escambia County Clerk's Office
LEGAL CONSIDERATIONS/SIGN-OFF:
The Quit Claim Deed was approved as to form and legal sufficiency by Stephen West, Assistant County Attorney.
PERSONNEL:
All work associated with this request is being done in-house and no additional staff is required.
POLICY/REQUIREMENT FOR BOARD ACTION:
Upon Board approval, County Staff will proceed in compliance with Section 46-139 of the Escambia County code of Ordinances.
IMPLEMENTATION/COORDINATION:
Upon Board approval, the Quit Claim Deed will be recorded in the public records of Escambia County, Florida.
