RECOMMENDATION:
Recommendation Concerning the State of Florida Department of Transportation Off System Project Maintenance Agreement - Joy D. Blackmon, P.E., Public Works Department Director

That the Board take the following action concerning the State of Florida Department of Transportation (FDOT) Off System Project Maintenance Agreement, related to a sidewalk project on County Road (CR) 296 (Saufley Field Road) where federal funding is available for resurfacing, roadway widening, shoulder reconstruction, and other minor related improvements:

A. Approve the State of Florida Department of Transportation Off System Project Maintenance Agreement; and

B. Authorize the Chairman to sign the Agreement.

The FDOT is using federal funding for this project.
BACKGROUND:
Federal funding is available for the costs of resurfacing, roadway widening, shoulder construction, and other minor related improvements on County Road (CR) 296 (Saufley Field Road). This specific project is a sidewalk project.

The Florida Department of Transportation (FDOT) is preparing to undertake a project within Escambia County, identified as Financial Project I.D. 433577-2-52-01, CR 296 (Saufley Field Road) from NAS Pensacola to State Road (SR) 10A. CR 296 is located in Escambia County and is not on the State Highway System. 

FDOT anticipates final design plans to be submitted for acceptance on June 29, 2016. The construction phase is not currently funded or programmed in the FDOT 5 Year Work Program, but FDOT staff plans to program the construction to occur within FY21 or FY22. However, because the design will be complete in late June 2016, FDOT staff will seek to program the construction earlier, if possible.

The construction cost estimate is $1,109,532.32, and FDOT is using federal funding for this project.
BUDGETARY IMPACT:
The FDOT is using federal funding for this project.
LEGAL CONSIDERATIONS/SIGN-OFF:
Kristin Hual, Assistant County Attorney, has reviewed and signed off on the Agreement, noting the following:

Paragraph 5 states that Escambia County acknowledges that the Department will be utilizing federal funds on the Project and as a result thereof Escambia County agrees to maintain the project in perpetuity according to FDOT standards; and

Paragraph 14 states that Escambia County shall be responsible for one-hundred percent (100%) of the funds required to make up any shortfall not paid by federal funds.

Public Works Department staff will continue to coordinate with FDOT and local stakeholders. Transportation & Traffic Operations staff will forward the signed Agreements to FDOT for final execution.
