RECOMMENDATION:
Recommendation Concerning the Conveyance of Portions of Two Separate, Abutting Parcels of Real Property to the City of Pensacola - Joy D. Blackmon, P.E., Public Works Department Director

That the Board take the following action concerning the conveyance of portions of two separate, abutting parcels of real property (totaling approximately 0.12 acres; each portion 0.06 acres) located at 2581 & 2601 Bayou Boulevard, to the City of Pensacola:

A. Approve the conveyance of portions of two separate, abutting parcels of real property (totaling approximately 0.12 acres; each portion 0.06 acres), located at 2581 & 2601 Bayou Boulevard, to the City of Pensacola;

B. Adopt a Resolution authorizing the conveyance of portions of two separate, abutting parcels of real property (totaling approximately 0.12 acres; each portion 0.06 acres), located at 2581 & 2601 Bayou Boulevard, to the City of Pensacola; and

C. Authorize the County Attorney to prepare, and the Chairman or Vice Chairman to execute any documents necessary to complete the conveyance without further action of the Board.

All costs associated with the accepting and recording of documents will be borne by the City of Pensacola.
BACKGROUND:

A concrete flume located at 2581 Bayou Boulevard was damaged during the April 2014 Storm Event. This flume serves as drainage for both Florida Department of Transportation (FDOT) and the City of Pensacola. During research, it was discovered the drainage right of way where the flume is located is owned by Escambia County. Escambia County has no interest in this drainage system or the associated property. FDOT and the City repaired the damage to the flume and the City has requested that Escambia County donate this property to the City.

BUDGETARY IMPACT:
All costs associated with the accepting and recording of documents for these parcels will be borne by the City of Pensacola.
LEGAL CONSIDERATIONS/SIGN-OFF:
The Deed and Resolution were approved as to form and legal sufficiency by Stephen West, Senior Assistant County Attorney. The conveyance of this property is authorized pursuant to Section 125.38, Florida Statutes.
PERSONNEL:
All work associated with this request is being done in-house and no additional staff is required.
POLICY/REQUIREMENT FOR BOARD ACTION:
N/A
IMPLEMENTATION/COORDINATION:
Upon Board approval and upon execution of the documents by the Chairman, staff will present the documents to the City of Pensacola for acceptance and recording in the Public Records of Escambia County.
