RECOMMENDATION:
Recommendation Concerning the Acceptance of Six Drainage Easements for the Mayfair - Algiers Drainage Improvement Project - Joy D. Blackmon, P.E., Public Works Department Director

That the Board take the following action concerning acceptance of the donation of six drainage easements for the Mayfair - Algiers Drainage Improvement Project:

A. Accept the donation of six drainage easements located in the Mayfair and Chasefield Subdivisions for the Mayfair - Algiers Drainage Improvement Project;

B. Authorize the payment of documentary stamps because the property is being donated for Governmental use, which is for drainage improvements, and the County benefits from the acceptance of this property, which enhances the safety and well-being of the citizens of Escambia County;

C. Authorize the payment of incidental expenditures associated with the recording of documents; and

D. Authorize the Chairman or Vice Chairman to accept the Easements, as of the day of delivery of the Easements to the Chairman or Vice Chairman, and authorize the Chairman or Vice Chairman to acknowledge the Board's acceptance at that time.

BACKGROUND:

Currently, the County has a project in design to correct the failing drainage stormwater pipe located along the residential lots on Algiers Street in the Mayfair Subdivision (5th Addition), the residential lots on Waltham Street in the Chasefield Subdivision, as well as the residential lots on Madison Drive in the Mayfair Subdivision (2nd Addition).  A 48" corrugated metal pipe (CMP) extends from Massachusetts Avenue, southward between the Mayfair and Chasefield Subdivisions. The CMP has collapsed in a couple of locations causing washouts to occur.  This project consists of installing ditch bottom inlets, and removing and replacing pipe. 

To help facilitate this project there was a need for  four (4) drainage easements along the lots in the Chasefield Subdivision.  The two (2) properties located in the Mayfair Subdivision (2nd Addition) have an existing 20' drainage easement, however the improvements to the drainage system required an additional 10' drainage easement. 

BUDGETARY IMPACT:
Funds for incidental expenses associated with the recording of documents are available in an Engineering Escrow Account accessed by Escambia County Clerk's Office.
LEGAL CONSIDERATIONS/SIGN-OFF:
The easements have been approved as to form and legal sufficiency by the County Attorney's office.
PERSONNEL:
All work associated with this request is being done in-house and no additional staff is required.
POLICY/REQUIREMENT FOR BOARD ACTION:
These actions are consistent with the provisions of Section 46-139, Escambia County Code of Ordinances.
IMPLEMENTATION/COORDINATION:
Upon Board approval, staff will proceed in compliance with Section 46-139 of the County Code of Ordinances.
