RECOMMENDATION:
Recommendation Concerning the Acceptance of a Drainage Easement at 1704 Shadetree Circle - Joy D. Blackmon, P.E., Public Works Department Director

That the Board take the following action concerning acceptance of the donation of a drainage easement (approximately 0.21 acres) located at 1704 Shadetree Circle, from Guy B. Girod and My Thanh Ngo Girod:

A. Accept the donation of a drainage easement located at 1704 Shadetree Circle, from Guy B. Girod and My Thanh Ngo Girod for drainage improvements;

B. Authorize the payment of documentary stamps because the property is being donated for governmental use, which is for drainage improvements, and the County benefits from the acceptance of this property, which enhances the safety and well-being of the citizens of Escambia County;

C. Authorize the payment of incidental expenditures associated with the recording of documents; and

D. Authorize staff to prepare, and the Chairman or Vice Chairman to accept the Easement, subject to Legal review and sign-off, as of the day of delivery of the Easement to the Chairman or Vice Chairman, and authorize the Chairman or Vice Chairman to acknowledge the Board's acceptance at that time.

BACKGROUND:
The property owned by Guy and My Thanh Ngo Girod, located at 1704 Shadetree Circle (Lots 27 & 28 of Block "A," Shadow Grove Subdivision), has an existing ditch on the rear portion of their property.  The existing ditch needs repairs and is not located in the existing 40' drainage easement that is located on their property.  In order to repair and maintain the ditch, an additional easement is needed to cover the damaged area.  This drainage easement is part of the Shadow Grove Drainage Improvement Project.
BUDGETARY IMPACT:
Funds for incidental expenses associated with the recording of documents are available in an Engineering Escrow Account accessed by Escambia County Clerk's Office.
LEGAL CONSIDERATIONS/SIGN-OFF:
The Easement has been approved as to form and legal sufficiency by the County Attorney's office.
PERSONNEL:
All work associated with this request is being done in-house and no additional staff is required.
POLICY/REQUIREMENT FOR BOARD ACTION:
These actions are consistent with the provisions of Section 46-139, Escambia County Code of Ordinances.
IMPLEMENTATION/COORDINATION:
Upon Board approval, staff will proceed in compliance with Section 46-139 of the County Code of Ordinances.
