RECOMMENDATION:
Recommendation Concerning the First Amendment to the Economic Development Transportation Project Fund Agreement - Joy D. Blackmon, P.E., Public Works Department Director

That the Board take the following action concerning the First Amendment to the Economic Development Transportation Project Fund Agreement (EDTPFA) between Escambia County and the State of Florida Department of Transportation (FDOT) for the transportation improvements on County Road (CR) 184 (Muscogee Road) and State Road (SR) 95 (US 29) in Escambia County:

A. Approve the First Amendment to State of Florida, Department of Transportation Economic Development Transportation Project Fund Agreement (EDTPFA) (On-System) for transportation improvements on County Road (CR) 184 and State Road (SR) 95 in Escambia County;

B. Adopt a Resolution authorizing the execution of the EDTPFA; and

C. Authorize the Chairman to sign the EDTPFA, Resolution, and any other document related to this EDTPFA Project.

BACKGROUND:
Meeting in regular session on June 2, 2015, the Board of County Commissioners adopted a Resolution authorizing Escambia County to enter into an agreement with the State of Florida Economic Development Transportation Fund (EDTF). This First Amendment is in response to a change in the scope of work that Escambia County is responsible to complete. County staff was notified that the Florida Department of Transportation (FDOT) is able to incorporate the extension of the right turn lane on SR 95 into Tree Street into their already-programmed resurfacing project for SR 95 from Nine and 1/2 Mile Road to just south of CR 184. The resurfacing project is programmed in FDOT's Fiscal Year 2017. The change in the responsibility from Escambia County to FDOT requires an amendment to the original agreement to formalize the scope of work.

The current project consists of the design and construction of intersection improvements along SR 95 at CR 184, Tree Street and Morris Avenue in Escambia County. The project will provide improvements to the entrances of International Paper Company along CR 184.

Escambia County will complete the project at an estimated total cost of $2,260,000 and FDOT has agreed to provide $1,950,000 toward to the total cost of construction.  

Escambia County has agreed by Resolution to accept future maintenance and other attendant costs occurring after completion of the project for the portion of the project on the county's system, no change is proposed to this portion of the agreement.
BUDGETARY IMPACT:
Funding is available in Fund 352, Cost Center 210114, Object Code 56301, Project No. 15EN3285 for $1,950,000 and Fund 352, Cost Center 210107, Object Code 56301, Project No. 09EN0115 for $1,047,000.
LEGAL CONSIDERATIONS/SIGN-OFF:
Kristin Hual, Assistant County Attorney, reviewed and approved the Resolution and the First Amendment to the EDTPFA as to form and legal sufficiency.

IMPLEMENTATION/COORDINATION:
Upon Board approval of this Recommendation, the Chairman will need to sign four original copies of the EDTPFA. The Clerk's Office will then need to certify three copies of the Resolution for FDOT and retain the original for the official records. Transportation and Traffic Operations staff will forward the four signed Agreements and the certified copies of the Resolution to FDOT for final signatures and for their files. 

Transportation and Traffic Operations staff will continue to coordinate this project with FDOT and the Purchasing Department for procurement of a contractor. Engineering staff will coordinate the project management.
