RECOMMENDATION:
Recommendation Concerning the Acquisition of a Portion of Real Property Located at 121 New Warrington Road for the Jackson Creek Improvement Project - Joy D. Blackmon, P.E., Public Works Department Director

That the Board either approve or deny by super majority vote:
 
A. The purchase of a portion of real property (approximately 3.17 acres - actual survey has not been performed), which excludes the professional office, located at 121 New Warrington Road, for the Jackson Creek Improvement Project, from Pugh Family Limited Liability Company, for one of the following:

1. The offer price of $170,000, which is the appraised value; OR

2. The counter offer price of $175,000, which is above the appraised value of $170,000 for the property and an additional 5,700 square feet (approximate) behind the professional office; and

B. Authorize County staff to draft the Contract for Sale and Purchase for the acquisition of a portion of real property (approximately 3.17 acres - actual survey has not been performed) located at 121 New Warrington Road, from Pugh Family Limited Liability Company, with a specified amount (if the purchase is approved); and 

C. Authorize the County Attorney's Office to prepare, and the Chairman or Vice Chairman to execute, subject to Legal review and sign-off, any documents, necessary to complete the acquisition of this property without further action of the Board (if the purchase is approved).

The summary appraisal for the portion of the property currently under consideration for purchase is provided.  The complete packet of appraisals for the parent parcel and the subject property is available for review in the County Administrator's Office.

BACKGROUND:
During the April 2014 Storm Event, Jackson Creek received damage at New Warrington Road and the resulting erosion encroached onto neighboring properties. At 121 New Warrington Road, the flood damaged not only the property but the storage buildings as well. Repairs have been made to the ditch west of New Warrington Road, which include improvements to the slope and the retaining wall, mowing of the ditch, and removal of debris.

In 2015, the National Fish and Wildlife Foundation (NFWF) officially awarded Escambia County over $11 million dollars in RESTORE funding for construction of five projects within the Bayou Chico watershed. Funds were awarded through NFWF to improve water quality and enhance wildlife habitat. Projects are located in all three of the main freshwater tributaries to Bayou Chico, including a floodplain restoration/expansion project to be located along Jackson Creek. Floodplain restoration along Jackson Creek will likely require acquisition of one or more properties. Meeting in regular session on July 23, 2015, the Board authorized staff to begin the process of obtaining necessary easements, parcels, and permits to complete the NFWF-funded restoration projects. Natural Resources Management staff has since completed an evaluation of potential project sites located along the creek, to prioritize properties according to the specified restoration goals and grant related metrics. The Pugh family's property was determined by staff to provide the best opportunity to achieve the NFWF grant objectives. A summary of staff’s findings has been provided with the recommendation. Funds received from NFWF will only cover costs associated with restoration activities.
BUDGETARY IMPACT:
Funding for this acquisition is available in Fund 352, "LOST III," Cost Center 210107/56101, Project No. 13EN2382. 
LEGAL CONSIDERATIONS/SIGN-OFF:
The Contract for Sale and Purchase will be drafted by Stephen West, Senior Assistant County Attorney. The County Attorney's Office will prepare the closing documents and conduct the closing for the purchase of this property.
PERSONNEL:
All work associated with this acquisition is being done in-house and no additional staff is required.
POLICY/REQUIREMENT FOR BOARD ACTION:
These actions are consistent with the provisions of Section 46-139 of the Escambia County Code of Ordinances.
IMPLEMENTATION/COORDINATION:
Upon Board approval, staff will maintain compliance with Section 46-139 of the Escambia County Code of Ordinances.
