RECOMMENDATION:
Recommendation Concerning Forest Creek Apartments Flood Mitigation Assistance Application - Tonya Gant, Neighborhood & Human Services Department Director
 
That the Board take the following action concerning the competitive Federal Emergency Management Agency (FEMA) Flood Mitigation Assistance (FMA) Program Application for Forest Creek Acquisition/Relocation Project:
 
A. Approve submission of the competitive FEMA FMA Program Application for the Forest Creek Acquisition/Relocation Project by ARCADIS U.S., Inc; 
 
B. Ratify the County Administrator's signature on the FEMA Grants Application Form for submission to the State; and
 
C. Authorize the Chairman or County Administrator, as appropriate, to execute all FMA or FEMA Grant-related documents as required to complete the application process, receive the Grant funds if awarded by FEMA and complete project related activities.

BACKGROUND:
Forest Creek Apartments, located at 34 Patton Drive in the Warrington community, is a privately owned 200-unit rental complex that is directly subsidized by the U.S. Department of Housing and Urban Development (HUD) through a contract with Marquis Group, the owner.  This complex has flooded repeatedly dating back through the 1980’s up through the recent April 2014 Flood event resulting in the temporary relocation of residents on each occurrence.  Post-Ivan flood zone revisions place the entire complex within an AE flood zone.  This complex is eligible to apply under the competitive FEMA Flood Mitigation Assistance (FMA) Program for acquisition/relocation to eliminate future flooding of the facility and to enhance safety of the residents as well as make improvements to the Jones Creek area.
 
With the assistance of ARCADIS U.S., Inc., a private consulting firm, an application is being completed to be filed through the FEMA online system which is due to the State May 3, 2016, and to FEMA June 15, 2016.  Application was made last year and in 2014, but was not recommended for award.  This year’s application will once again compete nationally with other submittals with a funding decision to be rendered late spring 2017.  If awarded, the FMA Grant will approximate $19.8M, including local share, and will provide for the acquisition of the existing complex, relocation of all 200 tenants to alternate HUD-approved housing, demolition of the existing buildings and all site improvements, and restoration of the property to a natural state effectively to enhance stormwater retention in this area.  The future use of the property would be deed restricted to prohibit redevelopment.  If selected for funding, the local share of the project will be a minimum of 10% of the total cost.  Required match for this project would come from RESTORE project funding of $2,029,200.
BUDGETARY IMPACT:
The Grant application totals $19,841,995.15.  Of this total, a minimum of 10% is required as a local share.  The local share will be borne primarily through RESTORE funds.
 
Funding will committed by the Board if the grant is awarded by FEMA.

No impact to County personnel at this time.
POLICY/REQUIREMENT FOR BOARD ACTION:
The filing of the FMA grant application and the related execution of grant forms and certifications by the County Administrator or Board Chair, as appropriate, are to be approved by the Board.
IMPLEMENTATION/COORDINATION:
If awarded, grant coordination will be provided through the Natural Resources Management Department and Neighborhood & Human Services Department and potentially supplemented by outside consultant(s) with FEMA expertise.
