RECOMMENDATION:

Recommendation Concerning Acceptance of the Donation of a Public Road and Right-of-Way Easement for South Old Corry Field Road Bridge Repair - Joy D. Blackmon, P.E., Public Works Department Director

That the Board take the following action concerning acceptance of the donation of a public road and right-of-way easement (10 feet x 317 feet, approximately 3,172 square feet) located at 610 South Old Corry Field Road from Roger B. Nicholson for drainage and bridge improvements:

A. Accept the donation of a public road and right-of-way easement (10 feet x 317 feet) located at 610 South Old Corry Field Road from Roger B. Nicholson for drainage and bridge improvements;

B. Authorize the payment of documentary stamps because the easement is being donated for governmental use, which is for drainage and bridge improvements, and benefits the public by the acceptance of the easement, which will enhance the safety and well-being of the citizens of Escambia County;

C. Authorize the payment of incidental expenditures associated with the recording of documents; and

D. Authorize the Chairman or Vice Chairman to accept the Public Road and Right-of-Way Easement as of the day of delivery of the Public Road and Right-of-Way Easement to the Chairman or Vice Chairman, and authorize the Chairman or Vice Chairman to acknowledge the Board's acceptance at that time.

BACKGROUND:

The 2014 rain event caused approximately 300' of Old Corry Field Road to be washed out above and on each side of the existing East Jones Creek box culverts. The proposed repair for this project will involve the removal of the existing box culverts and the installation of a precast bridge structure. The County is working with the Florida Department of Transportation for funding on this project.

The Public Road and Right-of-Way easement from Mr. Nicholson is needed to accommodate installation of a bridge that will be higher, wider and longer than the existing box culverts. The easement will also accommodate new sidewalk, stormwater infrastructure, and utilities within the area.

BUDGETARY IMPACT:

Funds for incidental expenses associated with the recording of documents are available in an Engineering Escrow Account accessed by Escambia County Clerk's Office.

LEGAL CONSIDERATIONS/SIGN-OFF:

The Public Road and Right-of-Way Easement was approved as to form and legal sufficiency by Stephen West, Senior Assistant County Attorney.

PERSONNEL:

All work associated with this request is being done in-house and no additional staff is required.

POLICY/REQUIREMENT FOR BOARD ACTION:

These actions are consistent with the provisions of Section 46-139, Escambia County Code of Ordinances.

IMPLEMENTATION/COORDINATION:

Upon Board approval, staff will proceed in compliance with Section 46-139 of the County Code of Ordinances.
