RECOMMENDATION:
Recommendation Concerning the Acceptance of Three Easements for the Wilde Lake Boulevard Project - Joy D. Blackmon, P.E., Public Works Department Director

That the Board take the following action concerning acceptance of the donation of three easements (one Drainage Easement and two Temporary Access Easements) for the Wilde Lake Boulevard Project:

A. Accept the donation of three easements located on Wilde Lake Boulevard for the Wilde Lake Boulevard Project;

B. Authorize the payment of documentary stamps because the property is being donated for governmental use, which is for road and drainage improvements, and the County benefits from the acceptance of this property, which enhances the safety and well-being of the citizens of Escambia County;

C. Authorize the payment of incidental expenditures associated with the recording of documents; and

D. Authorize the Chairman or Vice Chairman to accept the Easements, as of the day of delivery of the Easements to the Chairman or Vice Chairman, and authorize the Chairman or Vice Chairman to acknowledge the Board's acceptance at that time.

BACKGROUND:

The repair work on Wilde Lake Boulevard is a FEMA storm damage repair project. The project includes the replacement of the existing box culverts with a single span bridge. The road will have to be closed while the box culverts are demolished and the new bridge is installed, causing the need for the temporary Access Easements from property owners across the north side of Wilde Lake Boulevard (Cotton and Mather). These temporary Access Easements will accommodate the residents west of the bridge. 

Currently, the existing drainage infrastructure that is located on Mr. Vannoy's property is not under a County easement. By obtaining this Drainage Easement, the County will be able to access and maintain the existing infrastructure. 

BUDGETARY IMPACT:
Funds for incidental expenses associated with the recording of documents are available in an Engineering Escrow Account accessed by Escambia County Clerk's Office.
LEGAL CONSIDERATIONS/SIGN-OFF:
The easements have been approved as to form and legal sufficiency by the County Attorney's office.
PERSONNEL:
All work associated with this request is being done in-house and no additional staff is required.
POLICY/REQUIREMENT FOR BOARD ACTION:
These actions are consistent with the provisions of Section 46-139, Escambia County Code of Ordinances.
IMPLEMENTATION/COORDINATION:
Upon Board approval, staff will proceed in compliance with Section 46-139 of the County Code of Ordinances.
