A. Accept the donation of a drainage easement located at 2060 Staff Drive from Brent Michael Schiffer and Christi Colbert Schiffer for drainage improvements;

B. Authorize the payment of documentary stamps because the property is being donated for governmental use, which is for drainage improvements, and the County benefits from the acceptance of this property, which enhances the safety and well-being of the citizens of Escambia County;

C. Authorize the payment of incidental expenditures associated with the recording of documents; and

D. Authorize staff to prepare, and the Chairman or Vice Chairman to accept the Easement, subject to Legal review and sign-off, as of the day of delivery of the Easement to the Chairman or Vice Chairman, and authorize the Chairman or Vice Chairman to acknowledge the Board's acceptance at that time.

[Funding:  Funds for incidental expenses associated with the recording of documents are available in an Engineering Escrow Account accessed by Escambia County Clerk's Office]
BACKGROUND:
The property owned by Brent and Christi Schiffer, 2060 Staff Road, received stormwater damage. The stormwater caused erosion along their property and also endangered their privacy fence. The County was able to obtain, via donation, a Drainage Easement from Mr. and Mrs. Schiffer which will allow the Road Division to repair the damages caused by the stormwater runoff, and to construct the improvements needed to convey the stormwater properly. Additionally, the acceptance of this Drainage Easement will allow the County to maintain the stability of the drainage ditch and infrastructure.
BUDGETARY IMPACT:
Funds for incidental expenses associated with the recording of documents are available in an Engineering Escrow Account accessed by Escambia County Clerk's Office.
LEGAL CONSIDERATIONS/SIGN-OFF:
The Easement will be approved as to form and legal sufficiency by the County Attorney's office prior to execution by the Chairman.
PERSONNEL:
All work associated with this request is being done in-house and no additional staff is required.
POLICY/REQUIREMENT FOR BOARD ACTION:
These actions are consistent with the provisions of Section 46-139, Escambia County Code of Ordinances.
IMPLEMENTATION/COORDINATION:
Upon Board approval, staff will proceed in compliance with Section 46-139 of the County Code of Ordinances.
