RECOMMENDATION:
Recommendation Concerning Acceptance of the Donation of a Parcel of Real Property for the Tulip Park Project - Joy D. Blackmon, P.E., Public Works Department Director

That the Board take the following action concerning acceptance of the donation of a parcel of real property, located 2 Pen Haven Drive, for park improvements:

A. Accept the donation of a parcel of real property (approximately 0.25 acres), located at 2 Pen Haven Drive, from Pensacola Habitat for Humanity, Inc., for park improvements;

B. Authorize the payment of documentary stamps because the property is being donated for governmental use, for Tulip Park recreational improvements, and because the County benefits from the acceptance of this property, which enhances the safety and well-being of the citizens of Escambia County;

C. Authorize the payment of incidental expenditures associated with the recording of documents; and

D. Authorize the Chairman or Vice Chairman to accept the Warranty Deed as of the day of delivery of the Warranty Deed to the Chairman or Vice Chairman, and authorize the Chairman or Vice Chairman to acknowledge the Board's acceptance at that time.

The County Attorney has requested that the Board be made aware that there are significant concerns with the quality of the title of the property.

BACKGROUND:
Tulip Park is a two acre neighborhood park with amenities inclusive of a playground, picnic pavilion, and open green space for various recreation options. Currently, the public access to Tulip Park is at the end of Tulip Drive. With the addition of 2 Pen Haven Drive, the Parks and Recreation Department will be able to construct a pedestrian entry into Tulip Park. The pedestrian entry will help prevent various types of motor vehicles from entering the park and help reduce property damage, as well as create a safe environment for the youth and adults who utilize the park.  The residential structure on 2 Pen Haven Drive has been removed and the parcel is vacant.

On October 22, 2015, the Board of County Commissioners approved to support the concept of accepting Habitat for Humanity's donation of 2 Pen Haven Drive for the purpose of expanding Tulip Park.
BUDGETARY IMPACT:
Fund 352 LOST III, Cost Center 350229, Object Code 56101, Project #12PR1688 “Land Acquisition.”
LEGAL CONSIDERATIONS/SIGN-OFF:
The Warranty Deed can be approved as to form by the County Attorney's Office. Concerns regarding the quality of title and legal sufficiency of the deed will be addressed by the County Attorney at the Board meeting.
PERSONNEL:
All work associated with this request is being done in-house and no additional staff is required.
POLICY/REQUIREMENT FOR BOARD ACTION:
These actions are consistent with the provisions of Section 46-139, Escambia County Code of Ordinances.
IMPLEMENTATION/COORDINATION:
Upon Board approval, staff will proceed in compliance with Section 46-139 of the County Code of Ordinances.
