RECOMMENDATION:
Recommendation Rescinding the Board's Action Concerning Conveyance of Real Properties Located at 3414 West Jackson Street, 2505 West Lakeview Avenue, and 2615 North 6th Avenue to Pensacola Habitat for Humanity, Inc. - Stephan Hall, Management and Budget Services Budget Manager

That the Board take the following action rescinding conveyance of real properties to Pensacola Habitat for Humanity, Inc., a not-for-profit corporation using Escambia County's Surplus Property Disposition for Affordable Housing Development Program:

A. Rescind the Board's action of April 3, 2014, (Items 1-6 below), concerning the conveyance of real properties to Pensacola Habitat for Humanity, Inc., a not-for-profit corporation, using Escambia County's Surplus Disposition for Affordable Housing Development Program:

1. Declaring surplus the Board's real properties located at 3414 West Jackson Street, Account Number 06-3986-000, Reference Number 33-2S-30-3300-009-262; 2505 West Lakeview Avenue, Account Number 06-1327-000, Reference Number 17-2S-30-1300-006-033; and 2615 North 6th Avenue, Account Number 13-3648-000, Reference Number 00-0S-00-9020-014-094;

2. Adopting the Resolution authorizing the conveyance of these three parcels of real property to Habitat for Humanity, Inc.;

3. Approving the sale price of $20,840.25 for the three parcels of real property;

4. Acknowledging that Habitat for Humanity, Inc.'s design/structure shall be subject to architectural review and approval by Escambia County;

5. Allowing Pensacola Habitat for Humanity, Inc., up to a maximum of 120 days to close because of HUD (U.S. Department of Housing and Urban Development) approval requirements; and

6. Authorizing the Chairman to execute the Resolution and all documents related to the sale;

B. Declare surplus the Board's real properties located at 3414 West Jackson Street, Account Number 06-3986-000, Reference Number 33-2S-30-3300-009-262; 2505 West Lakeview Avenue, Account Number 06-1327-000, Reference Number 17-2S-30-1300-006-033; and 2615 North 6th Avenue, Account Number 13-3648-000, Reference Number 00-0S-00-9020-014-094;

C. Authorize sale of the property located at 3414 West Jackson Street to the bidder with the highest offer received above the minimum bid of $7,434, the Property Appraiser's current assessed value, without further action of the Board;

D. Authorize sale of the property located at 2505 West Lakeview Avenue to the bidder with the highest offer received above the minimum bid of $10,621, the Property Appraiser's current assessed value, without further action of the Board;


E. Authorize sale of the property located at 2615 North 6th Avenue to the bidder with the highest offer received above the minimum bid of $6,270, the Property Appraiser's current assessed value, without further action of the Board; and

F. Authorize the Chairman to sign all documents related to the sale.
BACKGROUND:
3414 West Jackson Street was acquired via governmental foreclosure in August 2013. 

2505 West Lakeview Avenue was acquired via governmental foreclosure in March 2014. 

2615 North 6th Avenue was acquired via a tax deed in July 2011.  On September 15, 2011, the Board approved acquisition of the subject property through tax deed sale in order to utilize the property for affordable housing.  A prior owner was under contract with the County to build a single family residence and sell to an income eligible buyer.  However, the developer abandoned the project.  The parcel requires completion of construction in order to sell the home to an affordable buyer under the State Housing Initiatives Partnership (SHIP) Program and/or Neighborhood Stabilization Program (NSP) guidelines.  On June 8, 2012, NEFI circulated the availability of this property to eligible not-for-profit agencies and the only agency to reply was A.M.R. at Pensacola, Inc. (AMR). Due to title issues (5 City Liens), AMR requested that the title be conveyed for the costs of the back taxes and title transfer.  However, the developer abandoned the project.  The parcel requires completion of construction in order to sell the come to an affordable buyer under the State Housing Initiatives Partnership (SHIP) Program and/or Neighborhood Stabilization Program (NSP) guidelines.

The Board at its April 3, 2014 Board Meeting authorized sale of all three properties to Pensacola Habitat for Humanity, Inc. (Habitat) for a sale price of $20,840.25.  Habitat failed to close on the property in the time allotted due to requirements to cure title defects.  Habitat has now notified Escambia County that it is no longer interested in purchasing these properties. 

Each property will be offered for sale via online public auction or offered as property to be used for affordable housing in conjunction with Escambia County's Surplus Property Disposition for Affordable Housing Development Program.

The County does not have a need for these parcels.
BUDGETARY IMPACT:
Sale of these properties will provide revenue for the General Fund.
LEGAL CONSIDERATIONS/SIGN-OFF:
All legal documents will be approved as to form and legal sufficiency by the County Attorney's Office prior to execution by the Chairman.  The purchaser(s) will pay all closing costs.
